My wifes ex who had custody of her oldest son, here after refered to as the "Pedo", got tagged by the state for civil child neglect and the Pedo was removed from the ex's custody. CPS is talking possible criminal charges as well. The problem is ex has a job that requires a security clearance and he is all freaked he's gonna lose his clearance and his job over the child abuse neglect issues. My problem is my wifes younger son lives with us and I really don't want to see the child support money train derailed. So, when would the clearance be called into question, if he is charged or convicted? Thanx. Jeff |

I guess he should have been enough of a man to do the right thing by his kids, instead of abuse of any kind. Sounds like you will be the sole support for the step children, kinda sucks but you married their mother, for better or worse, richer or poorer and all that jazz...... |

Let's see, what is wrong with this picture: You are worried about child support money train derailed. Ex is worried about losing his clearance and his job over the child abuse neglect issues. CPS is worried about getting a criminal conviction. NOBODY SEEMS TO GIVE A SHIT ABOUT RAISING THE KID. |

Some of you are missing some of the details, I don't give a flying fuck about the 16 yr old pedophile who abused his younger brother and my 8 year old son. I never said I was not going to take care of the younger son regardless. That said it is always easier with more money. Jeff |
Unfortunately, the X is being charged w/neglecting Pedo, Pedo was destroying and filfthatizing the home, smashing out drywall, pissing and crapping in corners, stealing from X and nieghbors and just being destructive. X banished him to basement, Pedo gets CPS involved and they take Pedo into foster care and intend to charge X with neglect. Fucking kid needs to be locked in a cage or (COC violation). I am doing my best to take care of younger step-son, he seems to have his head on straight. I am just sick of this little fuck messing up my wife and causing me stress. Now wife wants to get him out of foster care and let him stay at grandparent, I initially said fuck no, and that I'd dump her if she brings him back, but I decided it really wasn't my problem if he's at grandparents. I will be filing trespass letter with PD and if he shows up at my house, it's off to jail. Jeff |
One of my guys who needed a clearance on a Navy contract, was convicted of several counts of molesting his daughter and niece several times. The DoD would not revoke his clearance. but made it clear he was persona non grata. We finally let him go for abandoning the job while he was in jail after losing his appeals. |
X has no possibility of going to jail over this, it's all about the county/state getting the money from him. Hopefully, he'll get to keep his job, as he was NOT molesting the child, the child was molesting others in the past. The kid is just whacked and incorrigable. Jeff |

In the past 25 years - I have been absolutely AMAZED at what people have been gotten involved with, convicted of and otherwise known with complete certainty to be guilty of an maintained clearances at levels far, far above collateral TS. Don't assume someone will lose their clearance or access. In my experience they more often don't. |

He needs to inform his SSO/Security manager immediately of any possible charges that may be pending. Serious criminal allegations will result in a clearance suspension until an investigation by DSS/OPM/or whoever is investigating, is completed. If found innocent, clearance will be reinstated. If found guilty, clearance will be revoked. |

The best he can do is tell them the truth and try administrative redress, and he could still be downgraded or revoked. The idea that third parties are posting to public internet forums regarding his status is an even bigger issue. Is he one of those guys that tells everyone he has a clearance or something? |
| It depends. It depends on what agency, what level of clearance, what degree of culpability and whose rules he must follow. At this point he would be wise to go to his designated personnel security office/officer and take the upper hand by reporting, in writing, the full details of any official contact between LEOs and/or the Courts. He should be open and honest but avoid trying to blame his neglect (if true) on anyone but himself. Personally, in 15 years of managing the clearance issues for a number of contract personnel I have seen small things become big issues and seemingly big things get no negative action at all. A lot will depend on how this guy handles the legal process and his efforts to keep his agencies security people in the loop. |
