I guess I' just a little dense, but I thought you needed a NFA tax stamp for any rifle barrel under 16."  I see a lot of them being sold.  Can someone fill me in on whether I'm misinterpeting the statute, or what.  Thank you and I apologize if this is a stupid question.

You can mount less than 16" on AR-pistols.

If the barrel has a permanently attached muzzle device that puts the overall barrel length at 16" or greater it doesn't have to be registered. AFAIK.

i.e. 10.5" barrel, 5.5" flash suppressor.

Not a stupid question.

1) There are alot of us who have registered SBR's.
2) You can build an AR pistol.

AR pistols, some people put perm. muzzle attachments on their rifles, etc.

Some other people may still already have a tax stamp waiting.

Yes, actually it IS a stupid question.

You can own the barrel as long as it is not installed on a serialized receiver. You can buy it and put it in the kitchen drawer for 20 years for all the government cares. And it's none of your business nor does anyone need to help you understand it.

You can purchase the barrel, put in your paperwork with the ATF and pay your tax stamp and then install it.

Then again, you can also already own a Class III weapon and just buy one for a replacement.

It's illegal to drive above 65 on some roads in your area. Pardon me, but if it is illegal to drive 66, then why the hell are you allowed to purchase a vehicle that will easily exceed the legally mandated limit?

The ATF has also called a shoe lace a machine gun. Do you own any shoe laces?

Sure you don't work for the ATF? Your logic seems to indicate as much.

You can buy them all day and night. You just don't need to mount one on a rifle untill you've gone through the motions of getting an approved Form 1, to make a Short Barrel Rifle, back from the ATF. That'll cost you 200 bucks and about 6 weeks.

The same process can be done, but on a Form 4, to buy suppressors or machine guns (if they were made and registered before May of 1986).

Its perfectly legal.

The ATF can't perform inspections or go through your stuff without a warrant.

You won't get an IRS audit.

Any other rumors we can clear up?

I'm sorry Joe:  I just thought I could possibly figure out from those more knowledgable than I, if I was wrong on my idea of what I could or should do in purchasing a new barrel as far as the length was concerned.  I apologize if I offended you.   FYI: It is also ok to buy fertlizer for your lawn and you can use it with no problem, as it is intended to be used that way.  When you make a bomb out ot the stuff the authorities get a little angry.  The same with a hammer if you use it to beat someone in the head, that is not what it was intended for.  However, I guess I just don't know what I would do with a M-4 barrel other than mount it on a receiver and use it to fire bullets.  Lord knows what you use them for where you are.  No I do not work for ATF.  Thank you for your rudeness, you have solidified my opinion of your state.  To the others, thank you for your patience with a newbee and I appreaciate your comments and ideas.  I did not know the process was as simple as a six week wait and a $200. payment for the tax stamp.  /s/ Muskethead

Don't let people get to you here.  Sounds like joe is having a bad day and is taking it out on you.

As others have said, you can use it for an AR pistol.  

The finer point is not to purchase an AR upper that is <16" unless you already have an AR pistol lower put together or you have registered an AR receiver as an SBR.  

Yes, you could get away with just owning the 10.5" upper and no other AR rifles, but ATF is pretty anal about these things.  If you don't own an AR rifle then you shouldn't get into trouble, but the ATF may 'find' one in your house.

thanks a lot.  I just bought and received an LMT lower and it is a carbine not a pistol.  I saw so many opportunities for the 10.5 and 14" barrels that I thoiught I was missing the point.  the reply about the longer flash hider didn't occur to me, but that is good.  I decided to purcfhase a 16" LMT upper and will be just fine.  Thank you for you consideration.  /s/ Muskethead

Threads like this will get better information (and less grief), in the AR Discussion part of the site.

Not trying to beat you up for posting in the "wrong" place - just pointing you in the right direction.  The technical expertise in the AR forums of this site is truly mindboggling.
