The news tonight said the homeowner first shot at the robber when he (the homeowner)walked out his back door. Two would be robbers were fleeing. They said he actually "SAW" these guys as opposed to just shooting into the bushes as stated below. Either way this guy is in deep shit. Felon in possession. OOPS!


Sherwood, AR

Sherwood police arrest the homeowner, who they say shot a man on his property in October.

Prosecutors charged Larry Staley with two felonies, manslaughter and possession of a firearm.

Police say Staley acted recklessly when he fired shots into a creek bed to scare a robber who attempted to steal his four-wheelers.

Hours later, Staley's wife found 18-year-old Bryant Cross shot dead in the creek. Lieutenant Cheryl Williams says Staley could post bond, but he's refused to give up his passport.


News Release: Sherwood Police Department

In reference to the incident, which occurred on Oct. 23, 2007, in which 18 years old Bryant Cross, was found dead in the creek behind the residence of Mr. Larry Staley.

Mr. Larry Staley was arrested Wednesday at 2:30 p.m. on 2 warrants and transported to the Sherwood Police Department. Mr. Staley was charged with Manslaughter (Class C Felony) and Possession of Firearms By Certain Persons (Class B Felony). Mr. Staley was convicted of a Felony in Texas in the 1980’s.

Mr. Staley will be held at the Sherwood Jail and will be arraigned on Thursday Morning around 7:30 a.m. where his bond will be determined.

Well crap--any time a thief is permanently broke of his bad habit it's a good thing.  Too bad the guy will go to prison for his public service.

This brings up a good question regarding recent threads on felons with guns.  say the guy was being attacked by the robbers and he shot them, he would effectively put himself in jail for defending himself.  Further it opens the logical deduction of the right to ones self defense.  it would be resonable that one should be afforded the same means of defense as an aggressors offense, example, he has a bat, you should be able to fight back with a bat..  Follow?  As long as there are firearms in the hands of citizens and govt then any man who is prohibited from owniong a firearm is by default prohibited from the right to effective self defense and if he is killed, has he not been stripped of his right to life, liberty, and the pursuit of happiness and wouild this not fall under the whole "cruel and unusual punishment" debate?  

And this guy got in trouble 20 years ago..  I dont understand the lifelong ban since drunk drivers kill people and get to drive again eventually..  The more I think about it I believe the laws are as much about defacto disarmament as they are about public safety..
