I say you're absolutely wrong. Not to mention, unappreciative of the fact that he is man enough TO take responsibility and give you back every penny you spent. Some guys might tell you to claim it on their insurance or come up with any kind of bullshit story to lie their way out of it. No doubt he feels bad enough about his wife being an idiot. You have to insult him too, by expecting MORE money than you PAID FOR IT ????? ![]() Take your $700 and be thankful he didn't fuck you over like some might. Seriously... You don't know how easily you're getting off here. He might owe you for THAT rifle, but he sure as shit doesn't owe you anything more. Be glad you're getting your money back. |

Check with Bachman Pawn & Gun in Dallas Texas. They always list Reminton 700 Police rifles in their Shotgun News ads. In March they had a 700 Police in 308 for $719. They didn't have one in 300 Win Mag listed but I've seen them advertise them in the past. Phone number for them is 214-351-0572. |

While he should replace the rifle with one of equal value, without a court fight he's only obligated to pay what you're out. You could make the argument showing value and win in court. But how much is filing fees, losing your FFL connection and time away from work worth? |

Call the feds so they can find out why your property was not properly secured. Damn kitchen table dealers! Seriously, it sucks and all but he did own up to the fuckup and you won't be out a dime. Get a check for the amount that you are out and keep looking. Do you think that he is happy about this? |

Knowing how little some FFLs make, especially on someone using them for a transfer, I would take the money and the appology and shake his hand. Sounds like an honest (yet stupid), 'oh shit', mistake. In the end, you are no worse off. Be a standup guy and let it be water under the bridge. |

The stock alone is about $500 also, do you know what constant extreme temperature does to a rifles steel? The rifle is destroyed and cannot be brought back to firing condition. Its funny the first couple guys agree with me and everyone else thinks I am an ass. Lets say you bought an hk91 in 1984 for $600 used. And here we are now the rifle is worth $3000. If someone destroys it would you be happy with a check for $600? The thing is, it was a mistake, it was his mistake, and I shouldn't have to pay any extra for it. |

I agree 100% I'm not trying to pick on the original poster, but he doesn't OWE you anything more that what you paid for it. He's doing the right thing by giving you all the money you spent, and eating the burnt rifle himself. |

He owes you $715. He keeps the rifle, can do whatever he wants with it, you take the check and are returned to "zero" point. If I were the FFL, I'd hand you a check for $715, an apology, a handshake, and tell ya the next DROS fee is on me and I promise I won't let me wife near it. |

Chalk this one up to "worst luck ever", see if you can get another rifle out of him, and failing that - just take the $700 and let bygones be bygones. It'd be nice if he bought you another rifle, but in all honesty - him offering to pay what you have into it is still pretty fair. Given how little most home based FFL's make, my guess is this is coming out of his personal bank account. If he's an otherwise cool guy, just accept his offer and remain friends. |
That'd be a pretty good deal for the FFL in Michigan, since they don't do the whole DROS thing like California does. I think you meant "transfer". |
I have to agree here as well. It was an unfortunate event that happened, and just be glad he's willing to pay you for the rifle and not fuck you over. Just take your money and move on. And find a better FFl. Just my $0.02 |

If not, $715 is about the best you could hope for, considering the value of a used 700PSS. Had it been a rifle that had appreciated in value since you bought it, you might have an arguement for getting more, but it was not. |
I have asked him to help me find another rifle. There aren't many out there, and there are none for what I paid. And I do want to burn this bridge, this guy is a fucking idiot and he isn't getting any more of my money. He leaves the rifle in his garage unsecured? This guy is an ATF raid waiting to happen, and I don't want to be on his customer list when it does. For those of you saying if he gives me the $715 im not out anything, thats wrong. I am out the difference in cost for a new rifle, im out the cost for rings, and im out the rifle that I should already have. Think if this happened to you what would you want from the dealer? What would you consider fair? |
That was how I was thinking of it, and that is what I would consider fair. Suppose that instead of being burned in a stupid accident, the rifle had instead been lost in shipping, would you be demanding that the seller refund you MORE money than you paid him for the rifle? As far as I can tell, that's basically the logic you are using here, and I think it is a completely absurd logic.If you ask people for advice, don't tell them they are "wrong" when you don't like the answer. My advice is exactly that - my advice. Your OPINION may differ, but the fact of the matter is that lots of people are telling you that they think you are being unreasonable. |

I disagree in principle and agree in practice. Suppose you had paid nothing for the rifle. Say it was a gift. The guy would owe you replacement cost on the rifle. In this case, the $715 is close enough to the value of the rifle to not bother fucking around with the guy for the remaining $100 or whatever. Life is too short, etc. The OP should insist that the FFL guy trash the rifle. Smack it with a sledgehammer a few times. Otherwise the dumb shit FFL might try to rehabilitate the "flame broiled" rilfe and it will blow apart in some unsuspecting customer's face. The FFL will be sorely tempted to get part of his loss back out of the rifle's remains. (or should i say cremains.) |

Take the $715 and build the tiniest bit of good will with the FFL; you are likely to come out way ahead in the long run. Let's say Zanders has a smokin' clearance deal, and the FFL calls you with an offer to get the gun at cost - you know, stuff like that. I'm real skeptical about a "lightly used" .300 Win Mag rifle, too. That firearm could easily have a toasted bore and still look great on the outside. There's a reason the rifle was priced low, and it ain't likely it was the seller's good will. |
Nic Your only choice then is to take him to court,and that will quite awhile SO your money will be tied up for a year? 2 years? and AFTER the court proceedings you will ONLY GET the original $715 If you file a suit he DOES NOT have to refund your money,BUT if you take the $715 he wants to give you back the court will look on that AS if it were a satisfied RETURN so either get your $715 back and be happy OR let him keep your $715 for 2 years and then you will only get the $715 in the end anyway Get the $715 and be pissed off BUT be happy you got something back oh I was wanting to know,,just how HOT was that fire that it was a CONSTANT Hi-TEMP flame? Sounds too fishy to me. I say he owes you a new rifle, thats it. It shouldnt be up to you to go find another, you already did. If it costs him $850.00 to replace, then so be it. Not your problem. He is the one with the problem. He is a business, not a poor lonely guy. |
At best, he would pay the blue book value for an identical rifle and base and rings(I know that these are not in the blue book) in excellent condition. The dealer is offering to reimburse the entire amount paid for the rifle. I'd think that you would have a difficult time finding a court that would make him pay more, considering that the rifle did not appreciate in value between the time that it was bought and the time that it was destroyed. |

I wasn't telling anybody that they were "wrong". I was just making sure everyone understood my side of the story. I have already told the FFL dealer to order a new rifle and ill pay the difference. I even let him keep the burnt rifle. I think he wants to claim it on his insurance. I hope his insurance company tells him to fuck off and he doesn't get a penny for it. Now he his telling me that he wants a check from me for the difference first, before he orders the new rifle. I guess he is worried that I will fuck him like he fucked me. Oh well, I guess I will just have to pay the extra money and buy knew rings now. Anywho, thanks everybody for the replies. |
