I am trying to get a friend of mine into ARs.  

He told me that everytime he has tried to buy a gun weeks go by and ultimately there is no answer.  He was charged with domestic violence in CA over ten years ago but the charges were dropped.  

What steps can he take to get cleared with the ATF and be able to purchase a gun?

Can he write them a letter or petition them to revue his background or profile?

Any help here is appreciated.

Is he trying to purchase one from a gunshop? When they run the 4473 does it come back declined or delayed?

If it is only delayed and they don't call the FFL back after 72 hours (I think) he can proceed with the sale.

If he is declined then yes, he will have to try and contact someone.

I don't understand.  If you friend fills out a 4473, gets it called in and if they don't get a go ahead immediately,  then no call back within 3 days means that he is good to go.

Is he getting denied when they run a check?  If so he needs to find out why, have him go to his local PD and run a background check, will cost like $5 or something like that.  Then he can see what is on his record.  An arrest without conviction isn't enough to get denied IIRC.  Could be wrong.

Ditto the confusion noted by the above posters.

Get a new friend as he's not being straight with you.

NICS don't work the way you say he describes it.

He is a good guy, just a little gun-ignorant.

I will clarify with him but I don't believe that he was denied.   I told him that he should address it with them and get it cleared up.  

Thanks for the help, I will post when I have more information.

If he was truly denied then he can follow this procedure.


You may request the reason for your denial by writing to:

Federal Bureau of Investigation
NICS Section
Appeal Services Team, Module A-1
Post Office Box 4278
Clarksburg, WV 26302-9922

You must include your complete mailing address in the request. You may also submit your request by facsimile or by e-mail. (See reverse side for the NICS facsimile number and e-mail address.)

You must include your NICS Transaction Number (NTN) with your written request. The NTN can be obtained from the FFL.

The NICS Appeal Services Team (AST) cannot initiate an appeal for you at the request of another individual without your written and signed authorization.

You may submit your fingerprints, which must be rolled by a law enforcement agency, with your initial written correspondence. The submission of fingerprints with your appeal request may hasten the appeal process for you.

The NICS AST will respond to your written request by providing the reason for your denial within five business days after receiving your correspondence.

ATF doesn't run NICS, the FBI does - so he will need to talk with the FBI.

actually after the 3 days the dealer has the option of releasing the gun, they do not have to.  In fact it seems more and more are not releasing them, why because the FBI will wait a week and then deny the person, who is already in possession of a gun.  Guess who gets to go get that gun back?

As said above, unless he is indian and part of the slap-a-ho tribe, you need a new friend

Well i can tell you it's not the FFl. that's a matter between you and the FBI and/or the ATF.

He needs to get a letter from the judge/courts clearing him from the DV case. It may be hanging him up.....

If he was denied, the first thing he needs to do is to go through the NICS appeal process and find out why he was denied.  Otherwise, he is just guessing.  In the case of an NICS denial, the dealer should have given him a brochure explaining the process.
