Lets say as a young man you spent 5 years in the military and that was 15 years ago. You are now 39 years old. Are you eligable to be drafted if in fact the draft were reinstated?

but then again isn't the army taking enlistment to age 42 now?

My understanding is every enlistment is for 8 years. X number of years active duty and the remainder Inactive Ready Reserve. At any point during those 8 years you may be called back to active duty. Once called back they may keep you beyond those 8 years as well. Stop loss. However, once you have ETS'ed beyond the 8 years they cannot force you to go back in.

IIRC

So if you serve your 8 year commitment and you are still in the age group, would you be drafted?

No.  You start serving your eight years the day you entered service.  In some cases, if you were in the DEP program it started the day you took your first oath.

Congress can change the rules, but as it stands, once you complete your 8, you are done.  I got out of reg army in 93 and guard in 97.  I believe that I am classified as 4A.  Something like prior service not draftable???

This was my situation. DEP in 09/1994, Went to boot camp in 06/1995, ETS'd in 06/1999. IRR was up 09/2002.

1. The current draft rules would only draw from 18-26 year olds.

2. There's not going to be a draft.

But if you were an officer and got RIFfed and didn't resign your commision you could be recalled, even though your 8 year comitment is over.

under the current selective service system, 20 year olds get drafted first.  Unless it's world war 3 and we're fighting stalingrad-type battles, i just don't see 30+ year olds getting drafted.
