Yes it certainly does; those POS's in Camp X-Ray are to be treated as spies and summarily executed. They do not identify with any national army, wear no uniform, fight under no flag, hide amongst the civilian populous, flagrantly violate proper POW handling procedures, murder innocent non-combatants, etc... More importantly, even if they adhered to the Law of Land Warfare, they are not members of the select few signatory nations, meaning they are not to be afforded any of the protections outlined in the applicable conventions/accords. The said provisions are only intended for conflicts between nations who are a party to the conventions/accords. Last I checked, the Taliban and al-Qaeda didn't sign those treaties. EDIT: spelling. |

We know with a certainty that some people ended up at Gitmo who had nothing to do with anything terror related, but were simply in the wrong place at the wrong time. I've got no problem with executing terrorists, but there needs to be a legitimate trial where evidence is examined, and someone speaks on behalf of the accused. If the government's evidence isn't sufficient to stand up to the "give them a trial in front of an impartial judge" criteria, then we don't have sufficient evidence to start executing.
This isn't about the Geneva conventions, it's about doing the right thing. If we have legitimate evidence that is sufficient to demonstrate that these guys are terrorists, then torture away, and kill them when you are done. If there's insufficient evidence, then they should be treated humanely until we either get enough evidence to torture and kill them or we let them go. |
