Um, you are wrong, dead wrong. I am on jury duty for the next week. One the cases heard last week was a civil suit of guy a suing the guy b who shot guy a while guy a  breaking guy b's home.

Here in TX we call that a pocket gun.  They are useful in situations where you can't wear a real gun on the outside.   You see, everything is bigger in TX.



Unfortunately, like in public.  Sadly, no open carry in TX.  Let's work to change that.  It sickens me for the bastards from AZ (), CO, etc, etc, etc, to be able to use that as "evidence" they are "freer" than Texas/Texans.

Yet another reason why I believe this was not a "Texas" picture.

The major areas in the "Cone of Death" for Rita were Houston and, to a lesser degree, Dallas.  We've got enough members in those areas (DFW Crew, Houston Crew, etc) that, statistically, an EBR should show up somewhere.

If I'm wrong, and this pic *is* in TX, it is a perfect representative of a small/nonrandom sampling error.

My dad sent this out to the kids in the family with the above photo. As a lifelong police officer it makes alot of sense.



a. Not much more so than the actual purchase of a firearm for home defense would/could be considered "premeditated".
b. Holding a beer for a "photo op" does not constitute prima facie proof one is "intoxicated".  What did he blow?  
c. Txinvestigator or one of the other specialists on TX law can correct me if I'm wrong, but here in TX there's no law that says "Protecting life, good; protecting property, bad."

It is my sincere hope that you were just playing Devil's Advocate, from the POV of a POS civil atty.    Lord knows, as a lifelong police officer, you've prolly seen enough of 'em to be more'n a little jaded.

* Forget the dog.  Beware of owner.
* This house protected by Smith & Wesson three nights a week.  You guess which three!

I was also thinking of those as being bad signs to have around for exactly that reason. Ayoob had a column about just that a few years ago in one of the gun mags. Don't give the other side any ammunition to use against you in court.

I would also guess it would depend on venue, etc.  Judge, jury pool, actual jury, etc.  It might actually be a *plus* if the judge and most of the jury had at least one of those signs.  

Not too many states/counties I would put money on that equation working in the shooter's favor, though...........


(bottom line: I *do* see the point, it just angers me [on principle] that we've devolved to that degree.)
