As in this caes, if the water starts to rise at your home and you have to leave, question? Is your shtf ammo waterproof? How much ammo that you have stock piled can or would you take? Would a AR 15/10 owner, gun permit holder have to surrender thier arms while minimal law enforcement is available? Would you surrender regardless of your constitutional rights? Do we know when you no longer have that right, ie 911 or current scenario? Finally, is what we all prepare for (shtf) geared more towards defence of country scenario when the goverment calls "all hands on deck" to everyone in defence this country? Thanks |

What I mean is in a cival unrest situation more so than September 11th situation I guest, with limited security, forced to the streets with your AR, can local authorities demand you turn over your arms. Wganz, I was hoping to get a response maybe from a leo or someone who may give some insight on lawful possesion of a weapon in a marshall law type of situation with regardes to your rights. Lived the first 33 years or so of my life in Louisiana so I can tell first hand that there isn't a gun permit in Louisiana except for handguns in the former city of NOLA. Once martial law is declared by the Prez; well, all bets are off at that point. Google is your friend for martial law declarations. The way I understand it, if just depends on the order of the military commander that has assumed control of your area. This link tends to reinforce that although, IANL and YMMV. In strict dictionary terms, martial law is the suspension of civil authority and the imposition of military authority. When we say a region or country is "under martial law," we mean to say that the military is in control of the area, that it acts as the police, as the courts, as the legislature. The degree of control might vary - a nation may have a civilian legislature but have the courts administered by the military. Or the legislature and courts may operate under civilian control with a military ruler. In each case, martial law is in effect, even if it is not called "martial law."
