That's one of the worst NJ stories I ever heard.

Quoted:
I know a guy that went thru a similer account. Almost blow for blow. The difference was that when the sherriff showed up and ask about firearms he told them he didnt have any(standing uder about 8 different mounts from cape buff to cougar). They had a warrent and found three large gun safes in the rec room. He opened them up and much to the shock of the officers, they only contained a few mags, some ammo and some gold coins. No guns. They told him they know he has firearms and asked were he hid them. He simply said I dont have them anymore, I sold them all to pay for the divorce.

Fast forward to after it was all settled.
"You  ever going to come get your guns out of the vault?"

That is a true friend right there

I would certainly fight the felony conviction, and for 56k consider it a "bargain".  BUT if he wants NOW to go further and attempt to recover his losses for the property, I think he needs to do some simple cost-benefit analysis.   Principles are expensive, and sometimes you have to know when to pick up your teeth off the floor and go home.

That is why you also sue for legal costs.

IT whould be the law of the land that if you are found not guilty, the party pressing the charges, and any complicit parties, are responsible for all legal costs incurred fighting the baseless charges.

And in this case, the ex and the po-po would be be guilty, and have to pony up...

My best friend is a very successful medical malpractice attorney. One day I asked him: "In the trials that you've been involved in, how many trials had people that perjured themselves?" He answer was "Every damn one of them". What does this tell you? It tells you that many people will lie if they are put in a bad situation and lying will benefit them.

Here's a perfect example: I was sitting in my car- PARKED NOT MOVING. A guy comes through the parking lot and I see him looking at the passenger talking to him and not looking at me who is in his direct path. He runs right into me and does about $1500 damage to my car. He gets out of his car and tells me that it was my fault and that I HIT HIM. I was fookin parked with the engine shut off!!

1). Don't get married.

2). If you do, have a solid prenup. No alimony, nothing.

If it was ultimately found that she lied to get the restrainng order then there really WAS NOT any justification for him turning over his firearms. He should have immediately had the felony charge dropped because IT SHOULD NEVER HAVE HAPPENED IN THE FIRST PLACE. How does 2 wrongs make it right? Fuck his refusal to turn them over. In hindsight the cops should NEVER have been at his door in the first place. Anything shy of violence on his behalf after that point (like his refusal to turn them over) should be a moot point.

BTW, 3 pages and no JBT-apologists making excuses how they were just "doing their job"? At least they went home safe that night.

If this guy had gone off and whacked the bitch and the cops I would only hope I'd be on his jury. At least his first trial would be a hung jury.

To answer someones question about the worth of the guns?
I think on the low side about 7 grand.

The worth at the time he would not give them up was not the point, nor was it any Second Amendment ideal for him.
It was purely and simply the fact he was incensed that he had done nothing wrong PERIOD!

Paul,
The way it unfolded the Deputies would never have bothered to listen to the tape.
The fact he was innocent didn't matter to them, they wanted the guns because that is the law regarding orders of protection and they were following orders, right or wrong didn't matter to them.

How much were the guns worth?

There is a point where a rational person should cut their losses.  Dealing with "the man" has so far earned him 4 years of sleepless nights and 56k in legal expenses.  If this was originally about a rusty mossberg and a worn out Ruger 10/22...

I'm sure a large percentage of the legal fees were to overturn the felony conviction.

I'm no defender of the Californian Socialist State, but wasn't it you that said that both parties get to keep everything they had prior to marriage? If so that is certainly a step up from the norm.

Most people will NEVER understand the level of corruption in the legal system/court system until they see it up close and personal.

My wifes "Ex" has the local judges in his pocket.......we spent over $100K trying to keep his hands off my stepdaughter and we have "0" to show for it while he brags around town that he "pays for the judges decisions".....and he DOES!!!

America is doomed with these black robed demons making "legal decisions".

Yes, bullets ARE cheaper!

The same exact thing happened to an employee of mine last month.

Wife cheats on him.......
He catches her......
She throws him out of the house....
Wife Files a restraining order........
Police serve him with said order...
Police demand his guns and bow.....
He states that they are at his family's house in PA....
Police don't believe him. cuff him and take him downtown.......
Threaten to hold him for 72 hrs if he doesn't surrender the guns......
Police state that they will charge him with a crime after the 72 hrs. are up....
He finally caves in after 10 hrs.......
Police screw up his paperwork for the guns............

Ironically, I literally told him the day before to "SELL" his guns to an eligible person in case she filed a restraining order.

This, "So and So threatened me" BS should not be grounds for firearm seizure.

"Innocent until proven guilty".... Anyone recall hearing that somewhere?
