How hard is it to get an SBR? I mean, is it like Class 3 hard to get (with all the background check stuff , etc.) or is it  just a 'fill out a form and pay some cash'  kind of deal?

I'm up in Northern VA, where I hear it's impossible to get a Class 3, due to the liberalization of the area.  I don't want to throw the locals into cardiac arrest mode just because I wanted to make a 9mm AR look cool....

Heh, gotcha. That's what I thought, I figured you'd have to get a sign off from someone on it. Which would pretty much kill it for me, up here in FFaxCo.

Same paper work and process to acquire a class 3.

Also, drop the word Class 3 from your Vocab..  Class 3 refers to a dealer who deals in NFA weapons.  


You could say Title 2 weapons or NFA weapons..

All you need to do is get the proper paperwork and go donw to your CLEO and get him to sign off.  Concerning what TRH said, make sure you bring protection.

Then send all the completed paperwork to the ATF with your Fingerprint cards and the $200 check.

Not that big of a deal. Once your CLEO signs ( we have a GOOD sheriff here). Mail off your F1 and $200.00.   Mine was 88 days mailbox to mailbox.

If your Police Chief refuses to sign off, there's more avenues to pursue.

The Sheriff at my County's courthouse signed without hesitation.

And if all else fails you could go the "corporate" route.
Form your own corporation, and avoid the necessary  
"sign off" by a CLEO.

Before you ASS-U-ME anything about Title II weapons in your jurisdiction, do some research.

The NFA subforum in the AR-15 forum here is a good place to start.

Applicable Federal law is the National Firearms Act of 1934, as amended by the Gun Control Act of 1968 and the Volkmer-McClure Act of 1986.  State laws need to be considered, but you are in Virginia.

On the Federal level, to purchase a short-barreled-rifle, you apply to the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) for a TRANSFER (which is taxed) on the National Firearms Registry, using a Form 4. That requires it being signed off on by the 'chief law enforcement officer' where you live (sheriff or district attorney), a citizenship form, fingerprint cards and a $200 transfer TAX. It usually takes 3 to 12 months for approval (you must be legally able to buy a normal firearm - e.g., not a felon).

When the Form 4 is approved, you get it back with a tax stamp on it. You have to keep that (and keep a copy with the firearm if you are smart since BATFE is prone to lose their copy).

With an AR SBR it is simpler to 'make it' by SBR'ing the receiver.  That makes the lower receiver the SBR, not the upper.  To 'make it' you fill out a Form 1, have it signed off on then send it, the other forms and your check and send them in - and wait.

Don't even own your short upper until your Form 1 is approved (constructive possesion),

Your SBR is governed by all NFA rules - such as the form to take it out of state, etc.  It also has to be properly marked with the maker's name and address.

The easiest way to do it is to form a corporation (or LLC) and have the corporation make the SBR (a corporation is a legal 'person'). Corporate Form 4s go much faster as they require no CLEO sign-off or fingerprints.
