ยง 926A. Interstate transportation of firearms Release date: 2004-08-06 Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driverโs compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console. I'm going down to Virginia from NY at the end of the week. I'm bringing a pistol on my VA non-resident permit. I noticed that Delaware doesn't have a "peaceful journey law. The federal law above marked in red has me a little nervous...It seems that your covered under 926A if the state doesn't have a law against it...Am I ok with the locked case/ammo seperate until Virginia??? ETA: and yes I've been on packing.org...this is where I found it. |
Read the blue text. As long as you have it secured, you are legal to transport it through Delaware, or any state for that matter. |

From what I've read...If you transport locked with no ammo in case/box and legal at point A and point B the Federal Law is tops...Once the firearm is out of the case or unlocked or reachable the local/state laws apply...correct??? I'm a little nervous...first handgun trip across state lines. |
You're correct. If it's locked up, the state laws are for not providing you're passing through. That's not to say a cop wouldn't give you a hard time (like in Jersey where there have been problems with this), but if push comes to shove the law is on your side. |

"Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof" "Notwithstanding" means "In spite of" As long as you are transporting in compliance with 926A you should be OK. This does not mean that you can't be arrested and charged under state law as NY does to out of state residents that possess unlicensed handguns while traveling though NY. The real question is "What is a LEO doing in your trunk anyway?" |
I'll be in a trunkless car..."The Family Truckster"...(Minivan)...I found on the NJ website about transport under 926A and printed it out...can't find it on Delaware or Maryland...YET!!! |
