Can I sell a lower to somebody in the same state and just ship it to their house?  Seems like a bad idea to me.

It's a gun = you must use an FFL

You can in TN. It is perfectly legal here.

Check your state laws.

That's what I thought.  I keep telling these dillholes it must go through an FFL if not face to face transaction.  My buddy sold one a while back and got the same emails.

AFAIK, you can in Texas.  Transfers between individuals is not regulated.

Your State Attorney General would be the first place to start.

Legal in many states, but not particularly adviseable IMO.

You'll get lots of bad info on this, and lots of opinions.  Notwithstanding the laws of your particular state, here's what the law (and the ATF) says:

(B9) May a nonlicensee ship a firearm by carrier?


A nonlicensee may ship a firearm by carrier to a resident of his or her own state or to a licensee in any state. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm. [18 U. S. C. 922( a)( 2)( A) and 922( e), 27 CFR 178.31]

Those are the firearms related laws in TX as of the date of the publication.  If there is a prohibition on shipping handguns/long guns for transfers between "persons" it would be stated in one of these statutes.

Gunbroker's shipping guide says that it is okay to ship a rifle within the same state without a dealer, although I believe individual states could be different.
