The short answers are It can be if the restriction is based on protected first amendment speech. Yes. Yes. The first real case is Sherril Vs. Knight. Without getting to deep into it, it basically decided that the administration doesnt have to hold press briefings but if it does it needs to make them open to bona fide news outlets, and restrictions need to be based on 'compelling reasons' and not arbitrarily. Subsequent cases have held close to that. The administration is not without discretion but it also can't exclude outlets or restrict press passes based on the outlets editorial viewpoint. This round of exclusions will be challenged in court and the Whitehouse will have a really hard time defending it. It doesnt help that Trump has openly stated the restrictions are for reasons prior cases have found aren't legal. |
