It looks like they have the same rights as anyone else. https://law.justia.com/codes/georgia/title-16/chapter-7/article-2/part-1/section-16-7-21/ From the law you linked: "(b) A person commits the offense of criminal trespass when he or she knowingly and without authority: (1) Enters upon the land or premises of another person or into any part of any vehicle, railroad car, aircraft, or watercraft of another person for an unlawful purpose;" Further down after the law it lists case law decisions that include a person who sought to have a GA DOT employee charged with trespassing, which was held to be without merit because the employee was on the private property without permission in order to survey for a right of way, which is not an unlawful purpose. (Note that I am not supporting shooting the donkey here.) |
We've now proven that we have zero rights, just what privileges we are allowed at any given time.

It's mostly just southern cops and city cops here. Reddit is all cops. Those southern and city stereotypes exist for a reason. |

Under the Open Fields Doctrine, they did. That doesn't entitle them to trespass, that just says there's no 4A protection applicable to your "open fields" surrounding your curtilage. The police are generally privileged against both criminal and civil trespass when acting in the performance of their duties. Otherwise, it would be pretty hard to do police work. There's a ton of case law basically saying they don't have any rights to be on private property beyond what any other person would have, outside of warrants or exigency. |

Officer / department are liable IMO. I don't know how you repay someone for killing their pet on their property. I think they are owed more than Whoops. |

The officer in question probably will lose his job, and the department is liable to pay out some amount of money.............and say "not our fault". But at a minimum the officer should be discharged |

Police here have already explained this. A pet is property. So how much is a rescue donkey worth? That's what it is worth to a police officer. |

I think people underestimate how many of these stories are not about a cop being “scared”. They do things like this because they want to kill something. Whether it’s a donkey or a dog or a human. They carry a gun around every single day and are just itching to use it. |

I think the officer should be forced to replace the donkey. I'm not sure how good he'll be at fending off coyotes and being in a petting zoo, but I'm sure he'll quickly get the hang of it.
