I was wondering, if you get arrested, booked and fingerprinted, what happens to those records (pics and fingerprints) if you are found innocent or the charges are dropped ?
If they do keep them, how is that justified ?

I'm sure they keep it all in your file.  It's justified because just because you got away with something this time doesn't mean they won't get you next time....

Also, when they run the background check with fingerprints for CCW, do they keep them on file and enter them like any common criminal or once you check out, do they destroy it ?
I see no reason to keep arrest records of any kind if you are found not guilty or no charges are brought.  Is sure as hell see no reason to add them to a database of known criminals as if you are one of them.

Same thing applies with polygraphs. I have to take one for a new job in a couple weeks. If for some reason I fail it the "employer" will keep my failure on file. I will be unable to apply for similar positions and could prevent me from ever getting a security clearance.

Fuck it!  DoD has them anyway and some of my DNA I think.  Since Allthe alphabet agencies share info freely now it doesn't matter.


I would take off my tinfoil hat and presume I could have a one-nighter with some chic, she ends up raped and killed by soemone else right after we part ways and I could be held as a suspect.  Nice to have on your record, but that's without the tinfoil hat of course.

Big Brother owns your ass.

Fringerprints are not private or protected. You leave them everywhere you go. If you have ever been "booked" your prints ane entered into a national database handled by the FBI. If you have a CC permit they go to the same place. The same goes for form 1 and classIII licences. If you're not a criminal you have nothing to worry about.

If you are a criminal, please follow these simple instructions;

1. Load firearm
2. Place barrel in mouth
3. Pull trigger

It depends on the state.  The usual procedure is for the court to order that the arresting PD request the prints back from the FBI and all records that are associated with the case be sealed.  It may also be possible to get them expunged from the state criminal records system.

It's not a "big brother" or "tin foil" for me.  It's more like I don't see any reason to keep your info on file if they obtained it through an arrest where you are proven not guilty or the charges dropped.
Meaning, you did nothing wrong but you are now in the "system" just like  the guy who actually killed someone.
On the CCW thing, I see the need to check backgrounds and such, but once checked and passed, I see no need to keep the info as if you commited a crime.

I'm pretty sure it's part of your permanant arrest record, weather or not you are guilty of anything. I personally think that that sucks, & is just one more intrusion in to a persona personal life.
