| I have a question that some of you guys may have some clear answers for. I live in Miami, and most of the gun shops(what few there are)the guys are full of themselves. So here's the question, When/If the Assault Weapons ban ends, lets say I have a an Ar Lower(Post-Ban) and a Pre-Ban Upper....it's illegal to have the two together....so on Sept. 14th, 2004 when the ban ends, would I legally be able to put them together as one gun?? |

The AWB prohibits manufacture of new post-ban weapons in pre-ban form. As long as you don't make a pre-ban type weapon (by putting the two parts together), you're not making anything. Now the ATF has a problem with people having FA parts and the guns that they go into. But I've never heard of 'conspiracy to assemble a pre-ban weapon'. |

If you have any preban uppers in your house you had better be sure that you have a preban lower to go with them, or no lower at all. If you have a preban upper in the house with a postban lower and no preban lower to say that it goes on, you are an arrest waiting to happen. |
| thanks guys.....cuz I was gonna put another AR together and I have the Lower, but also can get a really good deal on a complete Upper in Pre, so I figured if they sat there in the closet until then, that'd it be ok....It's not Like i have BATF or the Locals searching my house so often |

You're not technically violating any laws by possessing the item, as long as it's not assembled into a post-ban weapon with illegal features. However, if for some stupid reason, the ATF had a bug up it's as for you, due to some "confidential informant" or a belief that you were doing something heinous, they could probably harrass you and cost you a lot of money defending yourself, if they discovered the pre-ban parts. |

In a related vein, at gun shows I've seen vendor's displaying "Preban AR-15 Uppers." This seems like they are trying to take advantage of people who don't know the law. You can buy preban uppers all day long, but they are useless without a preban lower. Some poor schmuck could think he's got something special, then a) realize he's been taken, or b) get into some real trouble. |
