I am glad in Texas that we are not only an At Will Employment state but further, as an attorney, wrongful termination suits are very rare. Basically I have never seen one where there wasn't something pretty egregious going on- blatant sexual harassment, clear racist intent etc....

Should have been shot beside the road for committing some kind of crime like that....oh, wait - that isn't a crime? Sad! Well, in our shiny, beautiful new bigly country we'll have to adjust the law for this kind of behavior. Sure she could sue and maybe that's why she mentioned the man who didn't get fired for his facebook post: to set up a discrimination suit. I'll bet she took the two weeks salary and signed away her rights to sue. Of course then you she can still sue. My point was, she's not going to win a suit. I think that there was probably a long running problem there and the management took advantage of her stupidity and used that picture as an excuse. Seems to me she was fishing for a lawsuit because why on earth would she go to work and tell HR about it? They can anticipate a lawsuit soon. So is my AO State and we frequently get sued for dismissing people who more than earned termination. Then we have to spend years defending the lawsuit and $50k of lawyer fees. That's why we rarely fire anyone unless they have proven they can't be rehabbed or for egregious policy violations. |

Asked what she was thinking when she saw Trump’s motorcade roll up next to her, Briskman said it was a gut reaction to flip him off.“He was passing by and my blood just started to boil,” she said.
“I’m thinking, DACA recipients are getting kicked out. He pulled ads for open enrollment in Obamacare. Only one-third of Puerto Rico has power. I’m thinking, he’s at the damn golf course again.” “I flipped off the motorcade a number of times,” she added. So where are her photos of flipping off 0bama going/coming from the golf course when the undocumented did not get amnesty? Or, when universal payer (socialist healthcare) was taking off the table by 0bama? I mean, shit, her party controlled both branches of congress, and the white house. |

Briskman said what’s been particularly infuriating is that a male colleague kept his job after recently posting lewd comments on his Facebook page that featured Akima LLC as his cover photo. She said this colleague was reprimanded for calling someone “a fucking Libtard asshole” on Facebook, but was allowed to delete the post and keep his job. View Quote |

Fired because she flipped him off? Or fired because she was otherwise mentally unstable? View Quote She was fired because her employer said she violated company policies regarding social media and obscenity rules. So flipping someone off is the same thing as the f-word. Since it was clearly her and she was flipping off the president, and her employer was a government contractor, they let her go. These things happen. |

While I like it when dems/libs get the shaft if she was fired solely for flipping the President off that is somewhat troubling as it is constitutionally protect speech.

View Quote Cops went down I-66, and pushed all the vehicles to a stop at each side of the highway. Everyone then sat around for 10-15 minutes until the motorcade came through, which took another 5 minutes to clear. I flipped him off too when he came by, because couldn't they have ordered the food in instead of shutting down an interstate during rush hour? Anyway, there are motorcades everywhere in DC and cars/traffic everywhere too. With rolling closures, they don't completely clear streets except for major events, when whole blocks are shut off and unattended cars get towed. Security isn't as OMG isolation bubble as everyone makes it out to be. |

What the other guy allegedly did has nothing to do with what she did. As far as that goes plenty of people tell the President to fuck off on social media, at work, out in public or wherever and get a way with it. They may not be municipal employees, or work for companies that have local , state or federal clients. Some jobs you kind of have to watch what you do off duty, others not at all.

Sometime over the past 8 years, I saw Air Force One was coming down at Ellington Field as I was driving down I-45S.
It was about 8AM so traffic was still pretty heavy, I was moving at a crawl. I saw a lot of middle fingers go up towards the sky that day. However I think she was empty that day and just stopped by for some routine reason. |

Cant blame them for firing her.
She posted the picture on social media as a badge of honor. As the photo circulated online, Briskman decided to tell Akima’s HR
department what was happening when she went to work on Monday. By Tuesday, her bosses called her into a meeting and said she had violated the company’s social media policy by using the photo as her profile picture on Twitter and Facebook.“They said, ‘We’re separating from you,‘” said Briskman. “Basically, you cannot have ‘lewd’ or ‘obscene’ things in your social media. So they were calling flipping him off ‘obscene.’”Briskman, who worked in marketing and communications at Akima for just over six months, said she emphasized to the executives that she wasn’t on the job when the incident happened and that her social media pages don’t mention her employer. They told her that because Akima was a government contractor, the photo could hurt their business, she said. View Quote She would still have her job had she kept silent.
