Wanted to know if I could ship 10 round Glock mags to a ban state, if that's what you call it ?
Is that the legal pistol mag capacity in those two states ?

Wanted to give these mags away to some gun folks that would use em, and was not sure how to do it without starting a shit storm on arfcom.
So I decided to ask the people that replied back in this thread that live in 10rd states, if they could use them.
Still waiting on a few replies back from some people that were offered these.

Lawless_Flogic has backup dibs on a G17 mag.
These will be mailed today 7/15/16 if I have your address.

2-G19 mag is going to DaveM499 in New York.
1-G17 mag is going to California_Kid in California
1-G17 mag is going to Lawless_Flogic in California

Id say you could even send a 30 round mag if you never plan on visiting. I'd be amazed if they could successfully extradite an out of state person for a mag violation.

Can you send replacement parts?

Suck to have to make multiple shipments, but staying legal if it is easy might be worth the effort.

Here are the mags I asked the guys if they wanted, the 2 19's are slightly used, the 17's are brand new, came with a 17L.
I will pay shipping also, the cheap stuff..no cost..no sale..no strings attached.
Just use em and don't flip em please, and take a kid shooting when you get time.
I will check back on this later.

1) There are no laws against sending any capacity magazine to any state. NY's laws do not extend into Pennsylvania.

2) It's illegal to have standard capacity magazines (over 10 rounds) in some states, like NY.

3) Only the person receiving them would be breaking the law. If we go by the new FBI "intent" standard, that means they intentionally ordered them and are not a really, really, Very Important Person.

4) Commercial sellers will not send magazines that might be illegal in those states, because the restricting state might sue them, and the legal fees the seller would incur are intimidating. At the least, a FFL would refuse to include them with a firearms transfer, the customer would be angry, etc...

I say "might be" because LEOs can (sometimes) possess them, unlike ordinary citizens.

The new law will take effect in July 2017 unless it is stopped in court.





Frankly
I think there is a good chance it will get overturned - Condemning
lawfully acquired personal property without compensation doesn't pass
moral muster and maybe not constitutional muster.





I don't know anyone who is planning to actually get rid of or turn in any magazines.

holder who shipped to a "ban" state a magazine to a person who could not
legally possess it would be at risk of getting in hot water with the
BATFE.



As for a non-FFL shipping a magazine to another state, I agree that there is no law against it.

It's in the regulations, not the law.  BATFE can pull your license if you don't adhere to all state and local laws.

A huge thanks to RWM. Members like him are what make this place great.  Got 2 g19 mags in the mail today. Shipped and delivered legally to my NYC address right in Manhattan. Suck on that DeBlasio and Bloomberg.

Now lets's work on getting this 10 round law thrown out.

you are missing his point... it is legal for you to ship anything you want to a ban state, you can ship them beta's if you like, because their laws dont apply to you...
