I found out our neighbor's son-in-law is a Tier III sex ofender. I also found his original conviction for sexual conduct third degree and multiple arrests for failure to register.  Given that third degree is the least serious how did he get to Tier III? Would multiple failures to register do it?

Every state is different. Multiple failure to register do not equal a re-offense. He may be a low risk to re-offend and just be non-compliant.



The questions that need an answer are:




Was this a juvenile offense or an adult offense?




Was there an actual victim? There can be convictions without an actual hands on victim.




What was the original charge? Was it violent or not?




What risk rating tool are they using? LSI, VASOR, SOTIPS?




Does he have other non-sex related offenses, and if so are they violent?




Too many variables to know. Just know that a sex offender is not always violent, or hands on. And the definition varies considerably from state to state. As do the rules for registration. For instance, you may have been convicted of an offense in New Jersey that does not require registration, but when you move to Colorado it does.




No consistency because there is no set of common definitions.

Ever since learning about the grayness of the whole thing, automatically assuming people convicted of sex offenses are scum has been pretty difficult. IIRC taking a piss outside and having a small child accidentally see could land someone on that list.

Not to mention the stories teenage girls can make up. If their boyfriend is a couple years older his ass could be toast in some states

He's non-complaint.  That alone tells me he wasn't some guy with a younger girlfriend.

Yeah, no. The whole probably peed outside, 18 yr old banging a 15 year old thing is bullshit. Never believe the offender, read the police report.
One of my co workers had the cousin who "had sex with a consenting teenager/statutory rape/I am innocent" bullshit. A quick check of court documents had him convicted of 3 forcible rapes.
Never believe the offender.

It's just skepticism. After learning how wishy washy it can be, reading what actually happened in simple English seems to be the best way to understand the events and character of the person.

Is it not possible that someone could be put in an unjust situation? If they are, it's pretty easy to see how they would say, "fuck registering." Now all the sudden they have multiple more charges piled upon them, and other people automatically assume just because of failure to register, he's in the wrong and was in the wrong the whole time, when he wasn't.

I can see how it can go both ways, that's all.

.300 Blackout suppressed.

It appears he was 20 YO. No information available on victim or crime. Previous arrests for failure to pay support. Suspected drug use base on my observations. Should be moving soon.
