Had an uncle die and may be willed a sizable collection with a handful of autos,maybe 6 or 7






Would I be able to put them in some kind of escrow until I could get the stamps or what would I have to do to keep these?

If they are indeed willed to you, they get transferred tax free on a form 5.
They executor of the estate retains possession until it is approved.

The firearms may not be transferred to another party, such as a firearms licensee, for consignment or safekeeping. This would be a transfer subject to the requirements of the NFA. The licensee may assist the executor by identifying purchasers and acting as a broker.
The firearms may be transferred on a tax-exempt basis to a lawful heir. The executor would apply on ATF Form 5, Application for Tax Exempt Transfer and Registration of a Firearm, for a tax-exempt transfer to a lawful heir. A lawful heir is anyone named in the decedent’s will or, in the absence of a will, anyone entitled to inherit under the laws of the State in which the decedent last resided. NFA firearms may be transferred directly interstate to a beneficiary of the estate. When a firearm is being transferred to an individual heir, his or her fingerprints on FBI Forms

If they are legal transferables, and you are stated in the will to receive them, it will be a Form 5, which is tax free to you.

If you are the named heir in the will, or the lawful heir by the uncle's state laws if he did not have a will, they'll come to you tax free in due time, and no dealer transfers will be required.

If you are not the named heir or lawful heir - e.g. your Aunt is the heir but just doesn't want to deal with the gun collection, especially autos - then the actual heir can pass them on to you as gifts from the estate, but that will require involving a dealer in your state if the uncle was in a different state; and tax-paid transfers to you from the estate.

We (girlfriend and I) have benefitted tremendously from others thinking about us in their passing.
Would give it all back in a heartbeat to have the people with us again.
