I'm selling an item on the EE.  One guy sends me an IM with the following text: INTERESTED What type batteries and does it appear to be working ok?

An hour later a guy posts an "I'll take it" in the ad and IM's me about payment options.

I couldn't find a rule in this regard and thought the matter to trivial to take to a mod.  Who gets the first dibs, IM of "interested" or posted "I'll take it"?  Poll inbound.

Personally I always favor responders with more positive feedback if I haven't commited to anyone, and see if a  deal culminates or not, then fall back on the 2nd guy.

If the interested guy has far less, or no feedback, but the 2nd I'll take it guy does, I'd go with number 2.

I'll take it would be the one. Post a "first one who says I'll take it gets it" in your ad next time. I always forget to do that myself.

Tirekicker vs. a guy saying it is sold

If the first guy said - "If it uses XX or is XX, I will take it"     -then that is a different story.

Tirekickers, hem haws, get put last in line.

Both are non-team but have good feedback.

None committed tire kickers take a back seat to an "I'll take it".

The first guy should have said "I'll take it pending a couple of questions" if he was serious about it.

I always say "first 'I'll take it' in the thread" so everyone sees it.  Plus I hate when an item is marked sold when there are no apparent other interested parties.

Finally, no accusations of favoritism when the time stamp is there for everyone to see.

You can sell it to whoever you want too but tradition is first I'll take it.

You can sell to whoever you want to, though conventionally the first unconditional "ill take it" gets it. I've had this happen a few times, people are pretty cool on the EE. Best way to avoid this in the future is more detail in the ad

This.  It also helps to put that in your ad, so it's clear.

Unless you left out a huge chunk of info that needed to be clarified, I would go with the first "I'll take it."

You can sell to whomever. You are only required to sell to the prospect that you first agree to sell to.
