The thought occurred to me the other day (while picking up a lower receiver ) that I have no idea how NICS works. When you buy a gun in the store, and they call in a background check to NICS, what does that actually check? Criminal records showing if you have be convicted of a felony? Mental health records?

Basically it wastes your time. They hope that it'll discourage you from actually buying a firearm. They think that in the time it takes for the NICS to come back you'll get fed up and decide not to buy whatever evil weapon you are there to buy.

It doesn't do shit when I buy a new gun. I have a Texas CHL and we're exempt from the NICS check.  I guess I need to start calling it a LTC now, they changed the wording to License To Carry when they approved OC.

I think the IG shoud audit the NICS program to make sure it is only doing what is is suppose to do. I would like to see the logic for what causes a "futher review".

I think the longest it ever took for me was an hour. Usually it's about 5-10 minutes. That one time it took an hour there were four people ahead of me in the store.

Florida doesn't use NICS.



We use the FDLE Firearms Purchase Program and you're run through FCIC/NCIC.

It acclimates you to the idea that you must obtain permission from the government before exercising your rights enjoying your privilege.
It also allows the government to populate its database which contains the names of gun owners.

And people say the government is inefficient.

In Virginia, the system is called VCheck.

It takes information about the prospective purchaser/transferee (name, sex, DOB, POB, race, height, weight, plus SSN if you choose to provide it) and reduces you to a uniqueish pattern of about 500 zeros and ones (remember, computers only count from zero to one and back, but do so really fast).

That unique pattern is then compared to:

  • Every felony record in the US for the last 90 years


  • Every open indictment for a felony offense across the US


  • For people 28 years old or younger, every record of adjudicated delinquent juveniles 14 years of age or older that would be a felony if committed by an adult, across the US


  • Every record of people anywhere in the US who were adjudicated as a juvenile 14 years of age or older who committed murder, kidnapping, robbery by the threat or presentation of firearms, or rape


  • Every record of a conviction of a misdemeanor crime punishable by more than 2 years across the US


  • All outstanding protective or restraining orders involving a spouse, a former spouse, an individual with whom you share a child in common, or someone you cohabited with as an intimate partner, across the US


  • All outstanding protective or restraining orders from any court that involves stalking, sexual battery, alleged abuse or acts of violence against a family or household member, again across the US


  • All records showing people who are an unlawful user of, or addicted to, marijuana, or any depressant, stimulant, or narcotic drug, or any controlled substance, as documented convictions for use or possession of a controlled substance within the past year, or persons found through a drug test to use a controlled substance unlawfully, provided that the test was administered within the past year, across the US


  • Every record of persons acquitted by reason of insanity across the US


  • Every record of persons adjudicated legally incompetent or mentally incapacitated, or adjudicated an incapacitated person, across the US


  • Every record of persons involuntarily admitted to a facility or involuntarily ordered to outpatient mental health treatment, across the US


  • Every record of persons who were the subject of a temporary detention order and subsequently agreed to voluntarily admission for mental health treatment, across the US


  • Every record of persons discharged from the Armed Forces under dishonorable discharge, for the last 90 years
    If a lawful resident alien, against the DHS database of lawful permanent residents


  • Every record of persons who are nonimmigrant aliens


  • Every record of persons who, having been a citizen of the United States, renounced US citizenship


  • Every record of persons convicted for the misdemeanor crime of domestic violence, across the US


  • Every record of persons who, within a 36 month period, within the last 5 years, has been convicted under Virginia law of 2 misdemeanor offenses for Possession of Controlled Substance or Possession of Marijuana (Handgun Purchases Only).


Now think about the vastness of that digital world.  

It is an unfathomable number of zeros and ones, all manually created by hairless apes making shit wages working for the government tap, tap, tapping on keyboards all the live-long day.

And your measly 500 or so zero/one unique pattern is compared to the entire set.

For some lucky people, it happens in seconds.

The vast majority of people in minutes.

Unlucky souls like me, take days (and I am a federal firearms licensee!)

Frankly, I am amazed by it.  

It is a singular achievement of computerized record management.

That accomplishes almost NOTHING except making it slightly harder for criminals to get guns.  Criminals still get guns and use them to do criminal stuff, but its not like they can walk into a store and buy one easily.
