Friend needs an overview of HIPPA or whatever the privacy law is called.  

I glossed over the contract he has to sign to see the doctor and it said by doing so they can pretty much access his medical records, previous doctors, etc for treatment purposes.

How would they obtain his medical records (insurance?) and find other doctors?  Can they contact his family or other shady stuff

Are the doctors required to make you give them access to that information?

What else does he need to know about this kind of stuff

The short version: You can't discuss anything about a patient, to another person, unless they are directly involved with the care of that patient.

There are a few exceptions like lawyers involved in cases and some broad research purposes.

How would they obtain his medical records (insurance?) and find other doctors?  Can they contact his family or other shady stuff He provides them with his prior doctors info, who will hand over the info when presented with the forms he is signing, they are not going to contact anyone other than who they need to.

Are the doctors required to include make you give them access to that information? No, but they also aren't required to have you as a patent.

What else does he need to know about this kind of stuff.

Honestly, HIPPA is for patient confidentiality and patient rights. HIPPA is your friend. It is strictly enforced, which is a good thing.  My wife works in healthcare and has access to all patient records. However, she can only access on a need to know with consent. Due to HIPPA, she is not allowed to even look at my medical records and if she does, termination and turned over to the Feds.  It is so stringent that after, I believe, 14 yrs of age, a parent can't obtain their child's record without their consent.

HIPAA is to stop patient records from spreading from a drs office to somewhere else.  It has nothing to do with a dr getting records from another office or person

The other office would require the patient to sign a release for the new dr to get the old records anyways

he's going to some sort of relationship counseling with a "doc" that can't prescribe medication, so he's not doing that.   I wouldn't want a shrink going through my medical records either and don't blame him for refusing to sign and not seeing this guy.

The Doc is a probably a psychologist.  He should receive a patients rights to sign too. HIPPA is good, but a statement on releasing records, I think that may have been tied into their paper work. Have him scratch out that part , date and initial it with a "hell no"

Why would you want to conceal your records from someone trying to help you?  So you can get away with lying?

Why would you assume someone is trying to get away with lying? How does lying tie into my appendectomy from 12 years ago?  I'm sure that he has to fill out a questioner. Good enough for a Psychologist. I bet it is voluntary for him to visit a Psychologist/Counselor
ETA: Now if you're seeing a Psychiatrist, well kinda of a different story IMHO. I would like to add, if his friend has past behavioral issues, well yes then he should sign a release.

Very much like FERPA doesn't prevent me from accessing relevant student records in the course of my duties as an educator/professor, HIPPA doesn't prevent doctors from accessing medical records they need to access in the course of their duties as care providers. (at least that's my understanding of HIPPA)

Because patients lie routinely, and those seeking mental health services probably lie more than most.

A medical record documenting 5 ER admits for suicidal ideation, alcohol detox, overdose, domestic violence, drug seeking can be very helpful.

An accurate medication list can be helpful.  I've had people tell me they were on an antipsychotic med for their blood pressure.  Many folks cannot accurately give you a list of their meds, dosages, and why they take it.  This is good to tell your psychologist/psychologist.

While psychologists can't prescribe, good ones may write a letter to a PCP or Psychiatrist and suggest meds may be of help.

I'm working from home today due to the monster snow storm, the dude is laying on my couch.  He just wants counseling, someone to help him figure out his shit without getting all crazy on his medical record.  

I now understand why they do it, sort of a duty of due care.
