How convenient for WHO(M)? I paid for my new NEOS 4.5" bbl. pistol and did the paperwork. Unfortunately, the shop owner had to come back with the very infuriating news that there's a 'delay'. Not his fault, I know. BUT, to the cheezebutts that caused the problem, I say --- THANKS A LOT. I have a week off and the weekends before and after that, but can I go home and fondle my new acquisition and take it out the woods with my kids for some fun right away? NO. Sorry, that just really 'fukks me off'! That's the second time. NEVER before that have I had any delay in purchasing a firearm. Now that I've ranted... Is there a way to call the NICS folks and clear this up so in the future I don't have this inconvenience, or, do I have some long lost criminal cousin I don't know about that keeps putting up a flag for me? Anybody? |

Without saying what it is, do you have a common name? The majority of "delays" involve someone with similar submitted information having a record. And if that is the case, you can honestly expect a delayed response for the rest of your life. I know a guy who has legally bought almost 75 firearms from me and it is now a running joke. We call him in on Friday and he clears by Monday. Problem is he has a common name and they always cross referrence him with someone who has similar info and a record. Another regular of me has a dirtbag for a brother who once got arrested and supplied "his" information to the police. Now even though it was cleared up by the police and the courts every single time I call him in he gets denied. He then has to fill out an appeal form complete with the LE/court paperwork to get the transaction approved (takes about 30 days). And of course they never update this information. |

Definetly not a common name. That's why I made the crack about the mystery criminal cousin... We talked at the shop about this and it seems I may be in for the running joke like you mentioned. One guy was in the shop and bought Kimber .45, I think, but, he was 'otay' and out the door in a few minutes. He, too, doesn't have a common name. Regardless of Kimber/Beretta or .45/.22, maybe he's just lucky. Who knows? |

Last October, I didn't supply my SSN (RIF, it is optional!) on a Winchester '97. INSTANT Proceed! Same scenario when I later picked my new match rifle. In December, my (well trained!) 9 yr old son wanted to buy me a Savage made Enfield No4Mk1 for Christmas. Out of curiousity, I deliberately put my SSN down, and was delayed for 15 minutes. They passed me from one operator to another, who was able to further review the records and give me a "Proceed!" Last week, when I picked up my Colt MT6400C [:D], I didn't put my SSN down again, and received an instant "Proceed." All of my transactions since May 2000 were through the same FFL, so that wasn't a variable. As a matter of fact, my dealer was surprised, because he was sure I would be delayed because of my deliberate omission. YMMV Dave |
| I've also heard mixed results from those who work in the nuclear power production field. Nuke plants do background checks up the wazoo (even more since 9-11, and more extensive during "high alert", and some of the people I work with have zero delays, and others might wait an hour or more. Until I talked to the guys who's checks went right through, I had the impression constant inquiries might throw up a flag. |

I use to get delayed everytime I purchased a firearm. I have a very common name and on top of that was arrested once in college (wrongfully) of failure to disperse after the UCLA Bruins won the NCAA championship in basketball. I don't even like UCLA and was just trying to get the hell out of Westwood after a nice dinner with friends when I got caught up in a riot and popped by the LAPD. I was eventually cleared and no charges were filed against me. This is the reason I was getting delayed. I found this out after I applied for my CCW in NC and got a call from the Sheriff saying there was a red flag because of an incident in Kalifornia. I called the LAPD's records division and cleared it up with them and was able to get my CCW permit. The CCW permit allows me to purchase long guns without enduring a NICS check so I don't have a problem anymore. |

I have a very uncommon name (I belive I am the only one in the U.S.) and it's always gone through immediately. Last time it didn't - and they called me three hours later with the approval. I think that sometimes the delays are at the other end - as in the NIOCS computer is down, or they are just really busy, or they're all taking a coffee break or something. |

I'm about to call the FBI or whoever and see WTF is in my name. My wife goes through instantly meaning about 2 min. I have no criminal record, only 1 speeding ticket (NOT reckless or DWI). |

I'm about to call the FBI or whoever and see WTF is in my name. Been there, done that. Actually, you write to the BATF with the NICS transaction number. The dealer will have the address. According to several BATF agents I've talked to, they throw away, without reading, letters wrt delays or denies that don't have the transaction number. Also, they said they won't do a thing about delays. I've never been approved to buy a gun, but I've never been denied either. As far as I know, I'm the only person in the country with my name. After sending a couple of nasty letters, getting someone from Sen Hollings office to call, and getting the husband of a relative that's a firearms instructor for the FBI to physically walk into the BATF's hq to ask about this, that's the best I've gotten. Nothing.z |
| NICS delays happen all the time. We find they are usually caused by someone with a smiler name who has a record, or if you have security clearance. IM not sure about other stated, but in VA you are required to have a social security number on the state form so thats not an issue here. Unfortunately not much you can do, we have people call all the time and ask why and try to get the problem corrected so they will not be delayed next time, but they get delayed anyway. |

All of my non black powder guns were purchased when I got promoted to E6 and was going thru a TS background check. First 2 were delayed, then a couple months later I spent the money on NC's pistol purchase permits and avoided the delay on 2 other guns. |
