II. Public comment on matters appearing or not appearing on the agenda that are within the jurisdiction of the Ethics Commission. III. Approval of the minutes of the regular meeting of July 12, 2004, and special meetings of August 4, 2004 and August 31, 2004. (Discussion and possible action.) IV. Executive Director’s report V. Consideration of whether, under S.F. Campaign and Governmental Conduct Code section 3.234(a)(1)(E), the Commission should grant a waiver to former Deputy City Attorney Ruth Edelstein from the one-year post-employment restriction imposed under section 3.234(a)(1)(D). A staff report on this item will be available from the Commission office and on its website on September 9, 2004. (Discussion and possible action.) VI. Consideration of resolution to delegate authority to the Executive Director to make decisions related to the pro-ration of public funds under Ethics Commission regulation 1.144-3(c)(2). The proposed resolution is as follows: “The Executive Director shall monitor the Election Campaign Fund for changes in the status of the participants (ie: number of candidates, number of candidates that withdraw, number of candidates, if any, that become ineligible by, for example, exceeding the spending limits, etc.) and changes in the funding level of the Election Campaign Fund (ie: potential increases from reallocation of other funds, increases in available funds due to decrease in number of active candidates, etc.) and at his discretion, adjust or readjust the pro-rated allocations based upon new information or the availability of new funding.” (Discussion and possible action.) VII. Commissioner questions and proposed future agenda items. a) Inquiries to the Executive Director. Commissioners may make inquiries to the Executive Director about matters of interest to the Commission and the Commission may request that the Director report back to the Commission on a particular item. b) Items for future meetings. Commissioners may propose items for future agendas and the Commission may determine the priority of these items. (Discussion and possible action.) VIII. Possible closed session held pursuant to Charter section C3.699-13, Brown Act section 54956.9(c) and Sunshine Ordinance section 67.10(d) to discuss anticipated litigation as plaintiff. Conference with Legal Counsel: Anticipated litigation as plaintiff Number of possible cases: 2 IX. Discussion and vote pursuant to Brown Act section 54957.1 and Sunshine Ordinance section 67.12 on whether to disclose action taken or discussions held in closed session. Motion: The Charter provides that deliberations regarding complaints are confidential. Pursuant to section C3.699-13, the Ethics Commission finds that it is in the best interests of the public (not) to disclose its closed session deliberations re: anticipated litigation as plaintiff. X. Summary of Commission Action. Commissioners will develop and approve a short summary of Commission action taken at the meeting and Commission action anticipated for the next meeting to be distributed to members of the public within 24 hours of the conclusion of the meeting. (Discussion and possible action.) XI. Public comment on matters appearing or not appearing on the agenda that are within the jurisdiction of the Ethics Commission. XII. Adjournment.
