The statement indicated that the vehicle was stopped and that he was exiting the car. Remember it was the shooters statement so the whole piece about how he was almost hit may have been an exaggeration. Again, I think it was likely a good shoot, but it seems a bit gray to me and I can see why it might be prosecuted. |

The Court bases these findings on the Defendant's testimony, the testimony of the blood spatter analyst, and photographs indicating the proximity of the vehicles, and the position of the victim's body, and the testimony of the witnesses, including Ms. Allison who is the victim's mother, regarding Mr. Elkins mental problems and prior violent tendencies, |
