I somewhere vaguly recall hearing somebody saying they prosecuted one guy, but it was a "add on" charge. I think the guy was a felon, and they just wanted to tack on more jail time. Then again, I could be wrong. Some cops out in the liberal parts of the country were bitching about the ATF taking a long time or never responding to inquires about if some military looking rifles were legal though. That I do remember reading.

What will happen is you will LOSE your gun. I've seen a couple taken in lieu of prosecution. Usually it is a case of the police being there for "other" reasons. In one case a guy was going through a divorce and his wife claimed he stole her television. The police arrived to look for said TV and came across some guns. Since they were semi auto military they had them checked out by ATF as possible "machine guns." While they passed the semi auto test, the side folders weren't quite legal. He lost 2 guns that day.
