Thank you. Perhaps I should elaborate. Shoot everyone? No, certain cases where deadly force is warranted? Yes. Oh, and I was hit and injured (working the main gate, I car surfed the hood of his Vauxhall) by a drunk GS-14 as a wee lad of 19 at RAF Chicksands, UK, in 1984. I didn't shoot him, but I could've. May I ask how many pursuits, or imminent death by speeding drunk/fleeing/escaped cons/felon motorists you have faced in your career? |

Use of Deadly Force 4th Amendment-Graham vs. Connor-these questions are asked: Objective Reasonableness Standard (A) Is the use of force "Objectively Reasonable" in light of the facts and the totality of the circumstance confronting the officer at the moment? (B) "Totality of the Circumstances" is described by the answers to the following: 1. Is the suspect an Immediate Threat to the officers/others? 2. Is the suspect Actively Resisting arrest OR attempting to evade seizure by flight? 3. Are the circumstances Tense, Uncertain, and Rapidly evolving? 4 What is the Severity of the Crime at issue? (C) "Objective" defined: 1. Not what the officer believes or assumes. 2. Only what the officer knows at the moment force is used. 3. It presupposes that any other "reasonably prudent officer" would have done the same thing in those same circumstances. (D) "Reasonableness" is demonstrated by a proper balance between the: 1. Nature and Quality (How?) of the intrusion and the 2. Governmental Interests (Why?) behind the intrusion. (E) In the case of a Fleeing Felon, deadly force can only be used if: 1. The officer has probable cause to believe that the suspect has committed a crime involving the infliction, or threatened infliction, of serious physical harm, AND 2. The use of deadly force is necessary to prevent escape, AND 3. The officer must give some warning of the imminent use of force-if feasible. Argument? No, I was agreeing with his statement. You took umbrage at that. I meant no disrespect to the fallen officer. Grabbing for more power? No. Please review the above posted SCOTUS view in that regards, from 1983 it's been the law of the land. I have all I need in that decision, thank you very much. |

I don't think you have any idea what this supposed "leeway" the cops are asking for really is (this is even assuming they're asking for any at all). The agency that I'm a reserve for wouldn't even be allowed to use a PIT maneuver to end a pursuit in this circumstance until after the driver had killed the officer because a PIT maneuver is regarded as "deadly force". |
