If the U.S. were to consider extraditing her wouldn't that be exposing her to double jeopardy, prohibited by the Constitution?
|

As found on Wikipedia
She served four years of a 26-year sentence before the murder conviction was overturned on October 3, 2011. However, on March 26, 2013, Knox's acquittal was overturned by the Italian Supreme Court. FUCK THEM! |

A smart decision. Many people in the US legal system think she got away with murder. At this point, I don't know to think. Many people in the US legal system are fucking idiots. No doubt. |

She shouldn't go back. Screw the Italian justice system. This whole thing has been an amazing display of why we didn't stay in Europe...

"Justice," "Italian," and "Court." Three words that don't go together.

I would give them the finger and vanish. This is the EXACT reason why we have double jeopardy laws.
I would hope that she is not extradited |

I'm not entirely sure I agree with this to be honest. So she was convicted, but then it was overturned. Now the courts say "no we want a conviction anyway" pretty much? can you imagine our justice if we allowed someone to be retried ONLY because the court wanted to convict them? I'm not entirely sure I agree with this to be honest. The convictions of Knox and her ex-boyfriend, Raffaele Sollecito, were overturned in 2011 for "lack of evidence."
.... Italy's Supreme Court decided last year to retry the case, saying the jury that acquitted Knox didn't consider all the evidence, and that discrepancies in testimony needed to be answered. So she was convicted, but then it was overturned. Now the courts say "no we want a conviction anyway" pretty much? can you imagine our justice if we allowed someone to be retried ONLY because the court wanted to convict them? You mean like the guys, including the "president", who wanted Zimmerman convicted at any cost even he being innocent? Now just imagine Europeans starting to kill Americans as "retribution". By the way, I'm not convinced she's innocent and apparently only escaped because of the usual legal technicalities. That just shows how the justice system worldwide is obsolete and corrupt. |

You mean how, if the state court does not give the PC verdict, the Federal Court tries them for "civil rights violations"? Yeah like that. "Zimmermanned" Yes it is. There is precedent it has been done before. Look up the murder of Vincent Chin back in the 1980s. After receiving a slap on the wrist, federal civil rights charges were brought and they got a conviction. http://en.wikipedia.org/wiki/Murder_of_Vincent_Chin |

I know nothing of this trial. Is she *REALLY* innocent? From a purely objective standpoint, is she innocent? Was she involved in any way?
While I understand the rule of law, and that Italy apparently has none when it comes to its courts... I really would have a hard time praising a murderer getting off scott-free based on a technical issue. Yes, she's cute,... but from a more serious standpoint, I'll have to reserve judgment/non-judgement of her until I find out more. |

It's pretty clear that the transient they were hanging out with killed her, and there is no motive or evidence that Knox and her BF were involved. But she did a lot of lying and even fingered an innocent guy during the investigation, so she is no saint. My personal theory is that she and her boyfriend were coked out of their mind and were trying to lie to cover up the drug use. |

There was no credible physical evidence that placed her at the scene.
There were no witnesses that placed her at the scene. They sent a local hoodrat to prison for the murder. The original prosecutor got his shit rocked for making things up. AND That same country sent a group of scientists to prison because they couldn't predict and earthquake. Fuck Italy. |

As stated above, going back would be stupid, stay here and make sure you have a good legal team.
As a backup plan, learn Spanish and marry a citizen of a South American country that doesn't believe in extradition. |

If I had to walk around in her shoes, I'd un-fuck my situation by assuming a new identity and changing my appearance. I don't believe she is guilty, but I DO believe there are people who want the poor girl dead.

After Douglas Preston and his Italian journalist friend wrote "The Monster of Florence" the prosecutor (who'd already arrested, charged and convicted four men four different times for the crime) arrested them, saying "they knew so much about the crimes that they must have committed the crime themselves."
Same prosecutor in the Knox case. The guy is woefully incompetent. |
