There will always be evil men, or misguided geniuses that would waylay the rights and lives of those they dismiss. Regardless of who is in power and giving orders - there is no excuse for "following orders" as many claimed at the Nuremberg Trials and subsequent hearings.
Our Country holds the same view of "following orders." Which is why all public servants swear an oath to uphold and protect the Constitution, and consequently the DOI and BOR. If someone is willing to subvert our civil liberties... everyone who has been voted/assigned/hired into positions of representation has a duty to protect their fellow citizens that they represent from infringement of the same.
