Lets say a guy is cruising ebay, sees something he wants, and it's at a decent price.. Sees a model number that sounds familiar, and hits the Buy it Now...

Then, a week later when he gets his item, he realizes that it's not what's pictured.

When he checks the model number, it's the SAME one that's on the listing detail, but a completely different (and considerably lower) model than what was pictured.

Ie. You bid on a Camaro SS (that's whats in the pics), but the VIN is for a base 6 Cyl, and when the car is delivered, you realize it's a 6 cyl and not the SS pictured.

So, do you say the seller is at fault for intentionally misleading customers? The buyer for not doing more research? Or both?

You are bidding on a used Motorola Microphone # 12345ABC in good condition but very dirty, needs cleaning.. Legal crap about paying in a few days, shipping, and blah blah blah.

BUT

Model number 12345ABC comes back to...





Which is what was received. (for this scenario)



There is a CLEAR difference between the two, and about a $50 difference, which could be attributed to the dirty/dusty condition of the item. Ie, the price was lower because of the condition of the pictured item.

The reason I ask, is because I bought it (it was ending soon), seemed like a good buy, but in reading his feedback, he has had a few people say that he sent them the wrong items, listing something different than what he actually sends. That's when I double checked the # and realized it was the wrong one. He has a ton of positive feedback, but the few negative I see revolve around sending the wrong product. I haven't actually received the item yet, just curious on GD's view on things, if indeed the wrong one gets sent (or, if you even think it's 'wrong' since it's listed in the description).

I always assume I'll receive the lesser of the two.



Meaning in this case, I'd count on them sending the model # listed, not the model in the photo.





When a photo doesn't match every detail in the description, it's a red flag. Feedback you mentioned would reinforce my suspicions.



If you receive the wrong mic, file a claim with paypal that the item wasn't correctly described. They'll take your side.

You def have grounds for an eBay claim.  He sent you something than was pictured, without clearly saying it was not a picture of the actual item, etc etc.  Misleading ad to say the least.
