I was checking out a story on a local newspaper's website on some upcoming changes to the local mall, and noticed a lot of comments from the community complaining about the mall being a gun free zone.  It got me thinking.  A lot of users on here have taken to writing their congressmen to combat any new AWB or similar legislation, which is awesome.  I haven't seen many, though, writing their local businesses/organizations to combat gun free zones.  Maybe it's happening and I just haven't seen it.  Anyways, Simon Malls owns the mall in question, so I sent them the following email:

I thought I'd bring to your attention some local concerns that were brought up in the comments section of a story in our local newspaper.  The web address of the story is: http://www.limaohio.com/news/local_news/article_5a613338-5617-11e2-a07f-0019bb30f31a.html

While the story details some upcoming changes to the Lima Mall, many voiced their displeasure with two key issues: the outdated facilities and the "gun free" policy.  I understand that renovations of large facilities such as a mall requires a great deal of planning, coordination, and (most importantly) funding.  I personally do not find the facilities of the Lima Mall to be as reprehensible as others may find them to be.  

What I do not understand, however, is the reason for keeping the mall a gun free zone.  Many in the community would like to exercise their right to concealed carry (with a permit of course) for their own safety.  In fact, there is a significant number of people who refuse to shop at the Lima Mall due to safety concerns.  While a security force may be present at the mall, it is my (and others') understanding that they are unarmed as well.  In the wake of recent tragedies, an alarming number of which were committed in "gun free zones," many businesses and organizations have reviewed their security policies for possible improvements.  I hope Simon Malls will do the same, and perhaps even ask for and consider input from the communities in which your business operates.  

If you do decide to review your policies, I hope that the removal of the gun free zone policy will be seriously considered.  Many opponents of concealed carry have voiced concern that unnecessary shootings will take place and crime will increase.  However, the evidence shows that this is not the case.  In fact, research has shown that the overall crime rate among concealed carry permit holders is not only lower than that of the general population, but also lower than that of the police.  

I appreciate your consideration, and hope to see serious discussion  and action taken on this issue.


I'd like to ask you all to keep writing your congressmen, but also start writing your local businesses.  A little education on this topic could go a long way for some.  

Side note: If you think there are any things I should add/change/delete in the email, let me know.  I'm thinking of using it as a template for contacting other area businesses that are gun free zones.

I guess this is as good a place to ask as any.  Sorry, i don't live in a few state.  No CCW for me!  (I'm obviously not trust worthy!)

What happens if you are caught carrying in a mall or restaurant that "denies" the right?  Ok, I'm sure they can ask you to leave and not provide you service.

Is there any legal ramifications?  I know that .gov and schools are gun free zones with legal penalties.  

Are private property bans controlled state by state for legal penalties or is all they can do to you is give the "stink eye" and a finger wag and tell you to leave?

(I think bars maybe different since they are passing laws in different states controlling that.  I'm talking malls and such.)

ETA:  not trying to hijack the thread.  The answer to the above would drive my response to the OP's question.  If they can't put you in jail, I'd say carry where ever you want.

Carrying concealed in a private building that has signs posted disallowing concealed carry is a fourth degree misdemeanor in Ohio (up to 30 days in jail and/or maximum fine of $250).  However, these penalties vary greatly from state to state.

PA they can only ask you to leave. If you refuse then you can be charged. My business is a friendly gun welcome Zone. If people don't like the fact that I have a gun they can leave. I do keep it concealed for the most part. But customers and visitors are welcome to carry as well.

Michigan they can ask/tell you to leave. If you don't can be charged for trespassing.

ETA: signs carry no weight of law.
