Looks like an old H&R to me. My friend's dad has a collection of old break over 32s and 38s dating back to the 1880s. He has several of the H&Rs as well as Iver Johnsons, S&Ws, etc.
H&R had the weird hammers like that I believe. Can't really say it's an H&R for sure though. |

Proofmark (extra load)
The Star with two letters is the inspector Take the grips off. Look inside the frame for manufacturer markings. This will include the gunsmith, and designer himself.
