Right before my grandfather was murdered in his bar, I remember the toxicology report saying he was .427, almost comatose.



The Sheriff and the Coroner pretty much stated that he knew it was coming, which matched the .22 bullet to the back on the head.



Anyway, that number has always stuck in my mind as particularly high.

That made me "lol".

I've been dumb enough to drive home after a couple of beers, but I have never been "pass out drunk" when I've done it.

It blows my mind that some people have no problem getting completely hammered knowing they have to drive.

Jesus. When I was in the ignition interlock business, my boss and I would throw parties at our shop and everyone loved to play with the various breathalyzers we had.

You had to damn near blow mouthfulls of booze through them to get those kind of numbers. And when you're blowing that much shit though them, their fuel cells get fucked and you have to send them back to the manufacurer.

During one party, I think we toasted about 6 or 7 interlocks...at about $1,200 each.

U of I college kids.  God love 'em.   2 days in jail, fine, court costs, drunk driving school, lawyer, SR-22.  Figure 10k.  Maybe less if he gets a cheap lawyer.

I never had my BAC tested  but Im sure in my younger days I got it up aound .3 or .4 a few times, never drove or anything stupid, plus I didnt get hangovers then. Now I have a pint and a couple of beers and thats it for me the next day.

Or his BAC was still climbing when they took him to get the blood test. It's possible to keep rising for up to an hour or more after your last drink.

Outside tolerance's of most handheld breath testers.  After .400 it really doesn't matter anymore, and the tester nor the officer care, it is obvious they are drunk.

This is from the Alco-Sensor FST which is a commonly used handheld tester in my area.
"Measurement Range      0.000 to 0.440"


If the agency conducts proper accuracy checks the tolerances are +- .002  on the Alco-Sensor FST.  Our agency checks every 30 days, and has a log of all checks.  I would say that is accurate.  And officer's in our county can't administer a breath test until after standardized field sobriety testing is finished, and based on those the officer will know if they are intoxicated.  I could care less what a breath test says, it just reinforces the observations on the testing.

Any breath test is reliant on the subject providing the sample actually blowing hard into the straw.  I've had plenty of cases where the chucklehead was either too drunk to understand what I was asking of him or they are simply incapable of blowing.  I've actually used the portable units many times just capturing a manual sample of the ambient air right in front of a passed out drunks face.  You know they're hammered when the ambient air in front of them registers better than .20

Worst I ever arrested was a 0.42 BAC......and he was a "good drunk".......total alcoholic, probbaly functioned somewhat normal at about a 0.20.

As pointed out elsewhere... even 0.486 would be outside the "spec" limit of testing for many handheld portable testers.
BAC also continues to rise for a while after one stops drinking as the majority is absorbed into your system in the intestines after it passes through the stomach.

It is pretty damn rare to see 0.350 or above.
0.400 would most likely be a "once in a career" stop for most officers.
In excess of 0.486?  That is statistically insignificant as an extreme outlier.

Using this single case as your reason to indict BAC testing is equivalent to using that dipshit Holmes as the single case to indict all of us gun owners.

From a few years back...





A Sturgis woman had a blood-alcohol level of .708 percent,
possibly a state record, when she was found earlier this month
behind the wheel of a stolen vehicle parked on Interstate 90,
according to Meade County State’s Attorney Jesse Sondreal.




I always found it amusing that they weren't sure if it was a state record or not.

I want to say we've had some in the .9 range, but I'm not sure they lived through it or not.

I worked in a hospital ER and saw lots of high BAC levels in my time.  The highest I ever saw was .720.  He was headed for the onsite alcohol in patient clinic and dry out and the cab driver that delivered him said he drank 2 large bottles of Vodka, one after the other, on the way to the clinic.  He was admitted for medical detox and we got to sit on him 3 days.  When he was at .720 he was talking normally and coherent, once he dropped below .6 he was slurring and, shaking and couldn't stand.  After about .4 he was fine again.
