| I hear people complaining about associations, only ever had little issues with them but never anything major... I rent in a HOA, they changed the laws on animals, saying only people who own are allowed to own pets and renters are not allowed.. this goes in to effect in October, I'm pretty much screwed unless I get rid of dog, I don't know much about Florida law governing HOA's but would cost me the same to move as it would to get an attorney.. Fuck Associations.. |

| Move. If your lease says you can own pets or if you have some sort of other pet agreement, I'd say the argue that the lease has been broken if the rules change part way into the term and you are suddenly not allowed to own pets. Ask a lawyer about it, but I'd expect that you could send him a 30-day written notice of your intent to leave because of the pet issue, then move to a suitable house without worries about getting sued. Again, I don't know what Florida law is, so ask an attorney. |

Fuck Associations.. The HOA can't do anything to you. They can go after your landlord, but if your lease says you can have a dog, landlord is pretty much stuck. |
| When I rented I was in an HOA and they LOVED picking on us. Neighbors who owned could have weeds all over the place and it was ok, we have 1 weed, Fined. Now I own and had a neightbor who rented. they told him he couldnt park his car on the street, yet EVERYONE that lived in the area, and owned, did, and was never bothered about parking on the street. |

An emotional support animal (ESA) is a US legal term for a pet which provides therapeutic benefit to its owner through companionship and affection. Emotional support animals are not specially trained to ameliorate disability as psychiatric service dogs are. They require only as much training as an ordinary pet requires in order to live peacefully among humans without being a nuisance or a danger to others.
In the U.S., two federal laws grant special rights to some owners of emotional support animals. The Fair Housing Amendments Act of 1988 (42 USC 3601, et seq.) establishes a procedure for modifying "no pets" policies in most types of housing to permit a person with a disability to keep a pet for emotional support.[1][2] In housing that allows pets but charges supplemental rent or deposits for them, these fees must be waived. The ESA's owner can be charged for actual damage done by the animal, but they may not require the applicant to pay a fee or a security deposit in order to keep the animal.[3] -WIKIPEDIA |
| HOA are bad for everyone. Mini Gestapo. We had to take our home owners ASS to court and won. They put a fat woman that didn't work, in charge of fines and she fined everyone in the neighborhood for everything possible. I had around $3,000. in fines for not parking my car in the garage and having my garbage can left out. Judge ruled they had no power to fine anyone!!!!!! |

Since you are leasing you don't have a copy of the deed, but it is public record and should be available at your county courthouse. If it isn't in the deed you may get them to back down, however since you are a renter and not an owner you are at a disadvantage here. |

Get your dog qualified as an ESA. Then when the HOA comes after you, sue them for violating the law. That'll shut them down pretty quick. I wont even go into the whole story but I just told my HOA I would foreclose on my house if they wouldn't leave me TF alone. It all boils down to
the brown paint on my front door isnt the brown paint they want me to have. I'm 100k upside down in the home and now they wanna be fascists when I pay my HOA dues every month like clockwork. |

OP, I think your HOA might have a legal problem. They've allowed you to keep that pet for so long that they might not be able to force you to get rid of it.
But the fact that your lease is up might tweak that. I recommend you look for someone to contact locally. A legal clinic or renters board or something. Even a lawyer, ask if they can suggest a place you can call for advice on this. |
