I work third shift as a welder.  I got off work this morning at 7am and noticed my eye was itchy on the way home.
Get home and check it out in the mirror and see that there is a small chunk of metal in my eye.  Never felt it go in either.

I call my works medical and they have me come in to check it out.  Now the situation turns shitty.  The Nurse Practitioner proceeds to take

the wooden end of cotton swab and jab at the foreign body in my eye.  I'm talking pain level of frigging 10!   She can't get it out and they

send me to an Optometrist where he's able to drill it out.  Very little pain and out quickly.  The metal was only like .06mm wide but the Doc. said

that there were two 3mm wide damaged area's where she went medieval on me.  Now here's the kicker.  They are forcing me to come back to work

tonight even though my eye is throbbing and I have a contact lens in to protect it and it's blurring my vision.  




How in the fuck can they do that.  I know why they are.  I just don't see how they can...?

Its an LTA if you don't come in, go in and tell medical you cant weld due to blurred vision, your foreman will find something for you to do.

Not being nosy, but what state are you working/living in?

I work with work-related accidents every day and different states have different comp laws. Most of the laws favor the injured worker.

That's how it's done, Son.

(You just have to be the kind of guy who they think might just bring in a flamethrower and go apeshit on them if such action would result in dismissal or something like that, and you really should have been cultivating that little "misconception" from the day you started working there.)
You just never know when it will be needed to work toward your benefit.

Drag up and sue.  That little scar on your eye will be a problem later on in life, I have one just about the same way you got yours.  Go see a qualified eye doctor and let him talke to you about it.

Doctor gave me and excuse for tonight and tomorrow night.  Safety at work doesn't want me missing those days because it turns
into lost work days...  Got a hold of my boss and says I have to come in and that I can't even take vacation days... Bullshit!

I can't help you with your worker's rights issues, but EVERY machine/welding/fab shop should have one of these:











Magnetic eye probe.  Rare earth magnet will painlessly suck metal slivers or fragments right out. $25 or so.

No, yes....  I'm going to go in there and hell's coming with me!  I worked there for 6 years without a injuries.  I get a piece of metal in my friggin eye on accident and this
is how they want to treat me.  Fuck that noise!  I've been awake now since 2pm tues and anger is building.  Fuck you Caterpillar!

I think the law states that if they can offer light duty then you can't stay home. If you do end up staying home, Work Comp laws say they're only obligated to pay 65% of your salary.
Get a note from your MD with restrictions listed. They have to follow those restrictions.

Like the previous post said, make sure you get your eye checked thoroughly.

You cost them an OSHA reportable incident, and probably some stupid safety record.

Your company claims they hold safety above everything else, but in reality they only care about the numbers.

Don't sign anything.  Don't agree to anything.  And watch your back.
You aren't playing ball.  They might try to terminate you for it.

Hope you can pass a drug test cause they will probably give you one if they haven't already when you return. Being "at work" should be all they are asking. To perform your normal duties would be above and beyond if you have blurred vision.

be damn careful..
I have a one eyed cousin that has almost the same story..
they thought they got all the steel and didnt...
I remember him snoring on our camping trips staring at me with that one glass eye..
Seriously,  getting hurt at work can be a bitch of a situation..
I pulled my bicep off the bone and had to have it re attached...
I was a contractor for an oil company and they black balled me for a few years and said I lied about where it happened.
I had short term and long term disability and had no reason to lie...If I had to do it again,,I would have lied and said I did it at home..
