I sure as hell wouldn't tailgate someone when it is raining.
While the van should have gotten over, the cop could have driven around him.

Normally I would say if a cop is riding your ass like that he probably deserves to get brake checked.......But if you're going to drive with your head in your ass move over to the right lane where you belong....

Hanging in the left lane like an idiot makes him a target for ANYTHING that happens to him.  Are you really saying the cop should have "driven around him" on the right?  That's not how this driving thing works.

I suspect something happened that drew the officers attention to the van before the video started, and the officer was trying to get a tag # off the van.

I think that he was close but that camera angle may have been a little decieving.  Without being able to count time from a fixed object because of the rain I dont know.  My first thought though was GET OUT OF THE FAST LANE.  Many states have a left lane for passing statute and you can be ticketed for driving in it.  I see not reason for the guy in the van to keep brake checking him when he could just get over.

Incorrect, it's the passing lane. You drive in the right hand lane and pass slow people by moving to the left hand lane then you move back to the right hand lane once you have passed them.

1. Break checking is illegal anyway. You're supposed to get out of a tailgaters way and let them pass.
2. I've been ticketed once upon a time for following that close on a clear sunny day.
3. It's possible that van guy was being a douche bag earlier and thus attracted special attention.
4. Maybe the cop found out van guy was screwing his wife.
5. I dunno.

I understand the rules of the road and all that, but you can't say it was a safe move to tailgate the van in the rain.
I get stuck behind people all the time and I would choose to pass on the right than to tailgate and risk a collision.
I don't have a fancy car with lights on top to push people to the right even though that is where they should be.
This would have been a perfect time for the cop to pull him over and inform him of the rules of the road.

Not always , SIL was driving on a road similar to the video, she ended up rear ending a guy when he swerved into her lane and slammed on the breaks bc  a deer ran out infront of him in his lane, I was surprised also to hear the other guy was at fault in the report and also at fault in the insurance companies eyes

Not necessarily.

If you intentionally swerve your car in front of another and slam on your brakes (sometimes referred to in insurance claim parlance as "swoop and squat"), the driver in front is the one at fault from a liability standpoint, even though his vehicle was the one rearended.

No, tailgating someone in the rain = dumb.  I don't care if you have a shiny badge.  Cop should be ticketed for following too closely and found at fault if there was a collision.  AFAIK, at least in Virginia, I have every right to drive in the left lane.  Also, good luck to the cop proving that the van wasn't slowing down for a puddle, low visibility, a small animal, etc.

In places where people live the left, or #1, lane is the fast lane that kooks and speeders use. Only in BFE is the left lane the "passing" lane that you have to get out of after you pass someone and back into when someone enters the highway on your right.

This.  Because I personally cannot say just from that video that the driver was intentionally brake-checking the cop.  In weather that rainy is is entirely possible to require use of brakes just because of road conditions.


And cop or not, tailing someone that closely in heavy rain & poor visibility... is not safe.
