.....do not work on idiots!
I have a hell of a time sleeping. I tried to get a couple hours in this afternoon. They ignore the sign on my door and ring the bell anyway. One asswhipe actually put his business card under my sign and blocked over the peep hole! I need a solution, preferably something that doesn't involve me going to jail. Ideas? |

Put up a No Trespassing sign and make a private person arrest....
13-1502. Criminal trespass in the third degree; classification A. A person commits criminal trespass in the third degree by: 1. Knowingly entering or remaining unlawfully on any real property after a reasonable request to leave by the owner or any other person having lawful control over such property, or reasonable notice prohibiting entry. 2. Knowingly entering or remaining unlawfully on the right-of-way for tracks, or the storage or switching yards or rolling stock of a railroad company. B. Criminal trespass in the third degree is a class 3 misdemeanor. 13-3884. Arrest by private person A private person may make an arrest: 1. When the person to be arrested has in his presence committed a misdemeanor amounting to a breach of the peace, or a felony. 2. When a felony has been in fact committed and he has reasonable ground to believe that the person to be arrested has committed it. |

I need to get a 'no solicitation' sign and put it on or about my front door. I don't get solicitors too often, but it does happen. Flat out, I'd be angry if I had a sign and someone knocked on my door anyway. I'd open the door and point to the sign and say "this means I do not want you disturbing me to try to sell me shit. You have done that against my express wishes. Leave now."

I agree. I have one on my front gate. I had this girl come up to my house from a home security company. These people come once a year at least. We have several soliciters over the warmer months. She rang the doorbell. I looked out and saw it was her so not to be rude I opened the door. I asked her why she ignored my sign that said no soliciting. She said "I am not soliciting". I asked her to clarify if she was trying to sell a service or product and she said yes. I advised her that this was the definition of soliciting and that I am not interested. She continued to try and be pushy. I told her have a good day and shut the door.

Signs don't work but I don't really have a legal solution either.
At my internship my desk was right in front of the main door to the office. I called it the fishbowl. There were signs on the entry to the building about no soliciting and on the office doors but that doesn't stop anyone. And being the guy sitting right next to the door guess who got to talk to them. I was always polite when telling them to fuck off. One guy was terribly persistent in wanting me to make some kind of purchasing decision for the office. I said "Dude, I'm the lowest guy on the totem pole here. I can't make any decisions like that. If I walk you back to my big German boss he's going to rip you a new hole so I suggest you get out of here while you can still walk." He left.

Criminal trespass in the third degree is only a misdemeanor. Arrest criteria #1 requires a breach of the peace. I highly doubt that knocking on a door constitutes a breach of the peace. Bad arrest. |

Trust me, in Arizona it is a breach of the peace.... |

Trust me, in Arizona it is a breach of the peace.... I'd rather not trust you, because my instincts tell me that's incorrect. Please cite where in the criminal code Breach of the Peace is defined as being as innocous as knocking on someone's door. |
