In Delaware if you are not on foot, meaning, Bike , Skateboard, Riding mower (Even on your own land), Car,Horse, ect.......
You can be charged with DUI.

So, use the PUSH mower to cut your grass if you have had a few.

I see to recall a case that got thrown out where this happened the argument was the horse was in control and would not do something like crash into a parked car.

Depends on the horse. My just plug along the shoulder and know the way home by themselves.

I remember awhile back someone getting arrested for riding a riding lawnmower drunk, and have seen people that decided to walk instead of drive and got it for public intoxication.

I don't drink, and do not like drunk driving in the least, but some of this shit is unreal.

I knew someone who got a dwi while riding a bike freaking clobbered.
Dude was so drunk the cops were afraid he was going to die from the booze.

All depends on the individual state...here it has to be a "Motor Vehicle" bicycles and horses are not motorized therefore no DUI

My grandparents have a neighbor who's an older native american gentleman who owns a few horses. Every once in a while when I'm over there cutting grass I'll see him slumped over on a horse passed out with it trotting down the street. Had to help catch one once when he passed out and fell off and it spooked and took off towards highway 59.

If you drive, you can be arrested. If you use public transportation, you can be arrested. If you walk, you can be arrested. If you ride a donkey, you can be arrested.

If I am riding anything on my deeded land that I bought with my hard earned money, you can kiss my fucking ass.  As long as I am not near a highway or causing problems, fuck you.

Since DUI can't be charged anyway on your own property in NC...what exactly does that have to do with the guy riding his horse drunk on a Public Street in Tx???  Not that I think the RWI charge is valid personally.

You shouldn't let your horse get that drunk. They turn into real assholes.

THIS is what happens when people listen to too much Toby Keith .....  OK frivolity aside (Really )  What WOULD the penalty for a horse-borne DUI be?? would it affect your DL?  After all i DON'T believe that you need a Driver's License in TX to ride a Horse.

Some states DO allow DWI on private property..... NC, where the poster I responded to does not IIRC.

For MN, driving, operating or controlling a motor vehicle under the influence if alcohol or drugs. On both public and private property.

Horse would be considered a vehicle, (same as a bike, skateboard, etc). not a motor vehicle.
