So I went to the fun store to get a new piece and the guy behind the counter ran my info on NICS and came back saying he got a delay .
Meaning no response . They have up to 5 days to let him know . If they don't say no then I am good to go . Gun shop guy said he had 14 guns on hold in his back room with the same deal . Lots of people buying guns now , He said . Anyone else have this happen to them . New thing to me > What the Heck !! |

Man, I hate having to tell people they have a delay. They are all sad, and I love helping people pick out a gun and see them leave all excited, gets me fired up to hit the range too.
Also, a lot of my state handgun hotline people are assholes too.... I'm a nice guy in a gun shop, sue me

Part time gun salesman here and yep the amount of delays we been getting is fucking ridiculous. We have a folder at least three inches thick full of delayed 4473's. Worst part is if you're military there's a 80% chance your ass is getting delayed, hold a security clearance and it's more like 90%. Some of these guys been waiting weeks with zero response and the owner won't release guns without one. |

Anyway, back on topic. I was only delayed once for about 3 hours, so I just ran back there when they called. I went back and got it, then they called the next day and they had written down the wrong serial number (they put down the number of another pistol of the same model that they still had in stock ) and wanted me to bring it back again.

Every now and then, NICS is just backed up, or there's a technical issue, or something to those effects. Seems that more often than not it has nothing to do with the person filling out the form.....though there are times where you can just eyeball it and tell ETA: Sometimes it has to do with people who have "something" on their record, but in order to ID what it is, some poor clerk somewhere has to go physically root through files. For those people who are "always" delayed, look into getting a UPIN––a Unique Personal Identifying Number. It'd go in the box next to the optional SSN box, and would indicate to NICS that they've already worked through whatever issue it is before, and it's a non-issue anyhow. |

I thought this was an ATF rule and not FFL holder dependent. |

I thought this was an ATF rule and not FFL holder dependent. When you call in, the dude on the other end of the phone says "Delayed. The Brady law does not prohibit you from transferring the firearm on XYZ date if you've not heard from us in the meantime", or somethign to that effect. Doesn't say "You must transfer it", it's more of a grey area indicating that there's nothing prohibiting the transfer.....which leaves open the possibility that you transfer a firearm to someone who shouldn't get one, they commit a crime, and can sue your ass off. Where I work has instituted a "if we don't get a proceed, they don't get the gun" policy because of the potential for lawsuits in this day and age. As a consumer, it's BS, but as a seller I can see how the possibility of such a lawsuit––however miniscule––isn't worth "the risk." |

If there are large gun shows on the weekends the call lines will be swamped. Not sure if in other states, but gun sales here in oregon are booming. It's almost like people are expecting a ban or something.
It's never happened to me, but I've seen others that had issues and had to wait. No sense sweating over it. Don't you guys remember the old days when waiting periods where what 10 days? or more. Oregon used to let you pick up a handgun on the spot with a CHL but when the "Instant check" program started a few years back they stopped that option. |
