I won an auction on GB.com and called the seller the next day to give him my CC. All seemed well.
A week went by and he contacted my to say he didn't have the item. It doesn't sound like he's a bad guy, just not that organized with his business which as property in three states . He offers me the opportunity to wait for him to get the item, or get a full refund––I take the refund.
Another week went by before I was credited back. Now I'm trying to decide on the appropriate feedback (if any) and I've never been in this situation before. ETA: He left me positive (A+) feedback so there is no need/probability of retaliation. |

It often takes around 5 business days for a credit to show up on your account. Well it actually showed the day after he actually processed the credit. This didn't occur right away either... |

So he sold an item that he did not have in possession? What was the item? ~$300 of ammo, I'd rather not give more details... Thats enough info. Did he give a reason for not having the item? Inventory management/employee issues. Like I said, he seemed like a decent guy who was just having a hard time keeping track of things. |

I won an auction (with nice photos) for a set of S&W football target grips on ebay. The guy sent me a set of the cut out style in nice shape. I contacted him wanting to know where the set he had pictured were, thinking maybe he had a mix up in shipping or something. His response was "send them back if you don't want them". They were worth what I paid, just not what I wanted. I never left feedback and made a note to not deal with him again.
I've bought some nice items on GB, did everything right, got the money to them fast, left favorable feedback for them and never had the seller leave feedback for me. If the guy didn't rip me off, I'd just leave no feedback at all and move on. Some of these people are knuckleheads or just disorganized. |

1. He offered the item for sale. (OFFER) 2. You agreed to buy it (ACCEPTANCE) 3. You paid for it and he accepted that payment. (CONSIDERATION) You then had a contract. He failed to honor that contract and failed to perform in delivering the offered goods. The fact that he didn't steal from you doesn't mean he gets a good rating. |

That's how I felt while it was going on and I was waiting for the refund. It also took him a week to realize he didn't have it! But now, looking back, I do appreciate his honesty. As soon as he figured out he couldn't perform under the terms of the contract he notified me and was honest. He could have strung me along for a couple of weeks waiting for the ammo to get in so he could ship it... So yes, the contract was broken, but the damages were mitigated. I found the ammo for $5 cheaper (SGAmmo.com) anyway... |
| Give him decent feedback, say, a "B" or a "C," but explain that he sold you an item he didn't have, but promptly refunded your CC. That way, others know what to expect. You may even add that you feel the guy honestly was trying to do proper business, he just got caught behind the curve this time. |
