The Montgomery County District Attorney’s Office says no charges will be filed in connection with a deadly shooting nearly two years ago in Schwenksville involving an off-duty SEPTA police officer and his neighbor.
KYW’s Brad Segall reports Darryl Simmons told investigators that he was headed out to get his daughter when Joseph McNair cut off his car in their neighborhood and initiated a violent confrontation.
Simmons told police he and his family had been threatened by McNair in the past. During this latest confrontation, Simmons told police it appeared McNair was reaching into his car and worried that he was going to pull a gun. Simmons drew his handgun and fired; killing McNair.
He immediately called 911 for help. DA Risa Ferman says her investigation corroborates the version told by Simmons and that he believed his life was in jeopardy and was justified in his use of deadly force.
There were also numerous reports that McNair threatened other people who lived in the same neighborhood.
