Every time I buy a gun I get delayed. It always gets approved eventually, but I'm sick of having to make a second trip to the gun store. Other than a public intoxication citation from 20+ years ago my record is clean. Does anyone else have this problem and is there any way to fix it?

is there any way to fix it? Posted Via AR15.Com Mobile Don't know about OK law, but in IA if you have a handgun permit(either to purchase or to carry) it eliminates the legal requirement for the NICS checkcheck. Lots of people I know who have no handguns get a permit because of this fact. I will say that everyone I know who has been delayed once gets delayed every time they are called in. |

Yes, I put in the social. After I got declined the gun store clerk told me that he used to get delayed until he stopped putting in his social. Not really his fault, but that would have been nice to know before I filled out the form.
Seriously, WTF, putting your social gets you delayed? Also, having a CCL in Oklahoma doesn't get you out of the NICS check for some reason. [Unless, they've changed something and I missed the memo] |

NICS is free, its the store charging the money U can also get a UPIN, I think its called. That will eliminate the delays Issue with UPIN(for the tinfoil-minded) is that NICS transaction records are purged after a civen anount of time. To throw a time out there, we'll say most records are purged Friday afternoon at 2:37PM. However, all records that used a UPIN are stored, not purged. They'll have all these records that you bought a gun, and since the record doesn't show if you sold a gun(or traded it to that dealer) it could look like you're stockpiling an arsenal. I don't think it's nearly the issue that a Minnesota gunshop owner thinks, but it's something to keep in mind if you're one who likes to try keeping as much information as possible quiet. |

Do you have a security clearance (TSS/SS). Interim clearance investigations can delay NICS approval on occasion. Other than that, common names don't help. (i.e. John Smith) Anyone use your name as a alias? Is this true? I have a friend who works for a national lab, and is always getting delayed... Honestly, it sounds like tinfoil. |

Did say "can delay" not will delay. Proof? Don't take this the wrong way, but I have heard that myth over and over again. Myself and many ex coworkers had clearances, and never had any problems. I fail to see how a .mil clearance has anything remotely to do with anything the ATF. |

He had a clearance but its been quite some time though. |

This is not BS. I had a higher security clearance in the Army and I always require a human under PICS in PA, never an automated approval. In NYS, under NICS, they try to delay me but the gunshops argue with the folks that I have a C&R, CCW, and NFA approvals on file and that It would be a hardship for me to make the trip back up there; the next thing you know, I am approved. Any inquiries for personnel with certain security clearances, past or present, automatically raise a flag.
In other responses here: In PA, a CCW won't take the place of PICS. Also in PA, during traffic stops, the State Police occassionally aske me why I buy so many guns. They don't purge all if any of that PICS check info. Quoted:

in many states if you get a ccw permit you can avoid the check alltogether. I wish Indiana would do that. I get delayed all the time and the carbon blobs at the NICS hot line suck in the helpfulness or lack there of. Indiana did until they found out that county clerks were not registering felony's with the State Police like there were suppose to and that was taken away from us. |

Neither of which deals with .mil clearances. Once again, if the delay has to do with clearance, please provide proof. An absense of proof is not a proof of absense. Simply because you have a clearance and were delayed, does not mean you were delayed because of the clearance. I had a clearance. Never once had problems. I also have an uncommon last name. Heck, there is even another person with the same first and last name, and I have yet to have any problems with multiple Title 1 or 2 transfers. Don't take it personally, but I still don't think .mil clearance has anything to do with the delays. |

I used to have it happen all the time. Makes buying something at a gunshow next to impossible. 3 day wait...they ain't gonna be there in 3 days. You can jump through hoops....and pay $18.00....and they will supposedly fix your info in the system. http://www.fbi.gov/hq/cjisd/nics/gunbuyer.htm |
