I received a citation for running a red light in Tampa Florida, yet I know I wasn't driving the vehicle.  I was home sleeping.  I believe it was my wife who had the car.  Now I know that Florida legislature states that an officer must witness the act.  Sure they see it happen on a video but you cannot see the driver.  There is not proof that I was the one driving the car.   How can I fight this in court?  Anyone had any luck fighting a ticket like this?

its not the State it the city, City Regs. IIRC

Yes I could and no there are no points, but why pay something I didn't do?  If there is no video or picture evidence of me driving the vehicle then the citation if invalid and illegal.

In VA you were able to provide a notarized explanation that you are not the driver in the pics and it would be dismissed. Go to Tampa's .gov website and do some research.

In VA IIRC, you can sign an affidavit on the ticket saying you weren't the driver when you send it back.  Then you won't have to pay it.

Too bad you're not in OC, Ca. An appellate court struck down red light cameras as hearsay.

from my understanding, it is often cheaper to pay the ticket than fight it in court.  surely the man knows this.  theres always an idea that if everyone went into court to fight the tickets, red light cameras would become unprofitable (i mean determined to not substantially increase intersection safety) and  then be removed.

By the way, If it makes any difference my wife is 6 and a half months pregnant and didn't want to slam on the brakes so she just rode thru. The timing on the light is 4 secs for a 45 mph road and the time that it took the picture at was 0.3secs into her crossing the line of prolongation and 1.3 secs to cross the intersection.  Also the burden of proof falls upon the prosecution and with out evidence that I am driving wouldn't this have to be thrown out?

Does anyone know what the timing is supposed to be on traffic lights in Florida? or where i can find this information? I am trying to find the information but can't find it anywhere.

I got one about a year ago. I stated that I wasn't driving and I don't know who was. They couldn't prove it otherwise and the ticket was dismissed.

There is a picture and also video. The Hillsborough Count Sheriff's Office has a channel on UTube and has a couple of videos of people running red lights. If I remember correctly, because it is civil and not a criminal charge the burden of proof is alot less strict. The SO is saying someone driving your car ran a red light....pay up.

I just found the loophole in the citation.  the law states in 2.8 Notice of Violation shall include (b):  license plate number and registration number of vehicle.   I reviewed the citation and there is no registration number on it.  They will have to throw it out.  ROFLMAO!

Is that for the Uniform Traffic Citation, the one you would get from an actual officer who has stopped you?  The civil violations you get from the cameras are not the same and may not need to meet the standard you cited.
