Ok, so my mom works at a Valero gas station. Well my dad and her are goign through a divorce, and he still has her under his health insurance and even sent her ...her insurance card. Well she got health insurance with valero (200 a month) out of her paycheck for this insurance. Well she didn't realize she was still covered under my dad's. And now she tries to cancel it. And they won't let her. I'm trying to get more of the story from her, but basicly she makes $7.75 an hour at the gas station and has no other income and they take $200 a month out of her check, and will not let her get off of their insurance. Is this bs? Or what? I'm confused. The way I see it she should have the choice if she wants their insurance or not. They can't MAKE her stay with their insurance. Any advice? or I'm I just missing something completely.

Your Mom is encounting a "change in lifestyle" - one of the few "outs" allowed in most insurance plans to allow a start or drop in coverage outside the "open enrollment" period.



These typically include marriage, divorce, and the birth or death of a family member.



But if he's the primary insured then he's the one who has to opt to drop her coverage, just like he's the one who opted her in in the first place.



But there should be no way his insurance company could mandate her paying for coverage under his plan. Have her tell them she want to COBRA and then don't pay it.

Maybe I didn't explain it right or I'm just dumb lol. But my dad WANTS her to use his insurance. It's the insurance from the gas station that is taking her pay. And it's not like she has to send in a check they just take it when she gets paid. My dad said she can be on his insurance until the divorce is final (which is looking like next year)

He means the company his mom works for won't let her opt out of their insurance. Nothing to do with the dad.

Oh ok. so i'm just dumb then

Sucks though because she barely makes $550 a paycheck and they take $200 out every month :(.

But thanks for explaining.
