Since using cell phones while driving is illegal, at least here in NYS, could a driver be pulled over and tickected for using a handheld mic while using either a cb or ham radio?
I was a frequent cb user back in the 70's and 80's and am thinking of getting back into it but don't want to get nailed if it's illegal.

This came up a few times at Dayton Hamvention last year and I dont know about CBs but Hams were exempt from it, as were Police, Fire, and EMS radios.

If I remember correctly (I just looked at this law a few months ago) hams are exempt from the no cell phone in school zone law in Texas. Texas changes it's laws on that stuff so often though. When I turned 16, you had to wait 6 months before you could talk on a phone and drive. When I was just about to turn 17 the law changed and you had to be over 18 to use "wireless communications devices" but due to the wording of the law two-way radios were allowed.

I believe Part 97 would nullify any local laws about hams using their equipment while mobile to begin with…but don't take my word for it.
