Finally got a MEGA lower on the way...2 actually. 1 is for my friend. Am I correct in assuming I can get them both transferred to me (thus only 1 NICS charge, I assume...I didn't ask my FFL) and just give him one without any formal paperwork? Any reason not too? Thanks. |

Dangerously close to a straw purchase. If you are certain that your friend is legally able to own the gun... and if you are giving him the receiver rather than having him pay for it... then you MIGHT be ok. Not worth it IMO; what do you have to gain from it? Have your buddy pay his NICS charge. |
| The only reason not to would be that the lower would have been originally registered in your name. If you trust your buddy and you're OK with that, then no problem. I'm not sure whether there will be one or two NICS charges. You'd think there should only be one, but I would check with your dealer to see how he will handle it. I agree with the poster above about the straw purchase issue, though and would be careful about it. |

If your intention is to purchase as a gift AND your not aware of any reason your buddy is not IN-eligible then you are OK. ANY other purchase is probably NOT. IOW: Buddy gives you money to do the double order + one PICS check. Even if the reason is to save PICS fees it is not going to be legal because it fits the description of straw purchase. Intent is not relevant. He pays, you do paperwork = straw. Not really any way around it. Stupid? YES. But the way the law is written it would be foolish to buy anyone a gun other than as a legitimate "gift". |
Scenario - You buy two rifles (receivers) from your FFL - PICS done,all laws and paperwork are complied with. Three days later you sell 1 rifle to a friend (who is not a prohibited person)for $1 and give him a receipt (also keeping a copy). All Federal and PA laws have been obeyed- end of story. |
