why do people think that it is a "LAW" that a individual can only make one firearm a year? I am talking about making a kit like a AK, FAL, or 1919...
i have heard this from many supposedly "knowledgeable" individuals who are prevalent in the kit building industry. Hell i was told today that i should put my 1919A4 on a form 1 so i can resell it later if i decide i dont want it. the kicker? the right hand side plate is a Wise light arms plate, IE it was already transfered to me by a FFL as it was 100% completed and just needed riveting. my question is, who is spreading this misinformation about "only one build per year"????? |

The issue, as I understand it, is not whether there is a "law," which I have not seen. The issue is what defines "being in the business" and requiring a manufacturer's license. ATF has pretty much said that if you build no more than one a year, you are doing it for your own personal use. If you are building more than that, you are in the business of manufacturing firearms and need a license.
It is analogous to brewing beer or making wine: a certain amount is for your own home use. Over that is probably for others and requires a manufacturer's license. |

Quoted: The ATF says that you are engaging in the business if you buy and sell for a profit. They do not specify how many though which is to their benefit if they decide to prosecute you.The issue, as I understand it, is not whether there is a "law," which I have not seen. These are the same idiots that will tell you that if there isn't a law saying you can own something it is illegal!
