I had a massage membership for my wife and I but we decided it was a something that we needed to cut out of our budget. They told us it would be a $50 per person cancellation fee.
Instead of canceling right awey and paying the fee they let us put the account on a 3 month freeze. I just got a call and the freeze is up on 08OCT and she said it would charge for another month on 09OCT. It is set up with automated withdrawals out of my wells fargo checking account. I have been thinking about closing this account for a while now as i really don't use it anymore. If I were to just cancel the account, is there any way for them to get the cancelation fee? Anything illegal about this? |

Say hello to collections  is that how it would work? I honestly have no idea. Most likely they would screw up your credit. If you signed an agreement, and then basically refuse to pay - they'll either turn it over to a collections agency, or sue you in small claims court. |

I can't speak to CO, but in LA closing a checking account when you know someone is going to be attempting to take money out of it (lawfully, as in for a service you contracted for,) is a crime. If the total amount the massage place needs to withdraw is less than $500 it would be a misdemeanor, if more, a felony. (Also criminal in MS, but I don't know the penalties offhand.) ETA: Not positive, as I do not know CO law like I do LA and MS law, but it looks like 18-5-206. "Defrauding a secured creditor or debtor" could be applicable in CO. |

If you are on automatic payments, ask the bank what happens when the place bills you. They might pay it, even on a closed account, and then the bank will nail you with overdraft fees plus the payment. Yep. Or they won't pay you and the massage parlor will turn you in to collections. You likley signed a piece of paper stating that you would fulfill your contract and if you cancelled then you agree to pay any fees. Yes, they will turn you over to collections. You made a contractual agreement with them and its time to pony up. |

In general, there is no right to cancel a consumer contract or purchase. However, there are some exceptions: In Colorado, you have the right to rescind a transaction under several circumstances: 1 Day On membership buyer club contracts, even if you sign up at the business. Consumer Protection Act, C.R.S. 6-1-706 (1)(a). Donation of goods such as furniture, clothing, toys, etc. have a one-day cancellation period. Consumer Protection Act, C.R.S. 6-16-106. 3 Days This is the usual time period, granted by the Federal Trade Commission rules, for door-to-door sales involving a transaction of $25.00 or more. You must be given written notice of the right to cancel. Details and exceptions to this general rule can be found on the Federal Trade Commission's Web site at http://www.ftc.gov. You also have three days to cancel on any home solicitation sale, which is a consumer credit sale (not involving a credit card). A consumer credit sale means, in general, a sale of goods, services, a mobile home, or an interest in land in which credit is granted or arranged, and such items are purchased primarily for a personal, family, or household purpose. Uniform Consumer Credit Code, C.R.S. 5-3-401-5, and 5-1-301(11). C.R.S. 6-1-703. 30 Days Hearing aids have the longest rescission period for refunds, although the cost of the individualized ear molds is not refundable. Consumer Protection Act, C.R.S. 6-1-701. You may have other cancellation rights pursuant to your contract or pursuant to certain federal rules. In most your cancellation must be in writing. This is best done by certified mail so that you have an accurate record of your attempt to cancel. WHAT IS A BUSINESS DAY? Any day except Sunday and official federal/state holidays.
